The owner, occupant or tenant of any property fronting upon or alongside of any of the streets in the Borough of Langhorne is hereby required to remove or cause to be removed from all of the sidewalks in front of or alongside of such property all snow or ice thereon fallen or formed within five hours after the same shall have ceased to fall or to form; provided, that snow or ice that has ceased to fall or to be formed after 6:00 of any evening may be removed at any time before 10:00 the next morning; provided, further, the owner of a property shall be responsible for conforming to the requirements of this section where such property is occupied by such owner or is unoccupied; the tenant or occupier thereof where such property is occupied by such tenant or occupier only; and the owner thereof where the property is a multiple-business or a multiple-dwelling property occupied by more than one tenant or occupier.

In any case where the owner, occupier or tenant as aforesaid shall fail, neglect or refuse to comply with any of the provisions of § 372-1 of this article within the time limit prescribed therein, the Borough Council or any officer or employee of the Borough designated thereby for the purpose may proceed immediately to clear all snow and/or ice from the sidewalk of such delinquent and to collect the expenses thereof, together with the sum of $2.50 for clerical services, and further together with a penalty in the sum of 10% from such owner, occupier or tenant, as the case may be, which may be in addition to any fine or penalty imposed under § 372-4 of this article. Such expenses and penalties may be collected by the Borough either by suit in assumpsit before a Magisterial District Judge of the Commonwealth of Pennsylvania or any court of record or by the filing of a municipal lien upon said property.
It is hereby declared to be the intent of this article that the duty to remove snow and ice from the sidewalks in front of or alongside property in the Borough of Langhorne shall be placed upon the owner, occupier or tenant of such property. The passage of this article shall not be construed as imposing a duty upon the Borough of Langhorne, a municipal corporation, to remove said snow or ice, and no person shall have a legal cause of action against the Borough of Langhorne, a municipal corporation, by failure of the said Borough of Langhorne to exercise the privilege to remove snow and ice from the said properties where the owner, occupier or tenant shall fail, neglect or refuse to remove said snow or ice.

Any owner, occupier or tenant who shall fail to remove any snow or ice from any sidewalk as required by § 372-1 of this article shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings, provided that such fine and costs of enforcement may be in addition to the expenses incurred by the Borough of Langhorne, including the clerical expenses of aforesaid and the penalty as hereinbefore provided.. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this article in equity in the Court of Common Pleas of Bucks County.
