The Mayor's Playground, Lojeski Acres ("the Farm"), and Catawissa Park shall be designated as smoke-free and/or vape-free, and the use of any smoking product or vaping product in any form shall be prohibited. For purposes of this article, "vaping" shall be defined as the use of an electronic cigarette ("e-cigarette") or other similar device that simulates smoking smoke by the use of vapor. Borough Council may, by resolution, designate additional public places and properties as smoke-free and/or vape-free areas.

Young Lungs at Play signs or other appropriate signage shall be posted delineating the smoke-free and/or vape-free areas. The Fire Marshal or Zoning Officer is empowered to post no-smoking and no-vaping signs in and around all designated areas where smoking and vaping is prohibited. It shall be unlawful for any person to obscure, remove, deface, mutilate or destroy posted no-smoking and no-vaping signs.
Council authorizes its elected and appointed officials to take whatever steps are necessary for full participation in and compliance with the Young Lungs at Play Program and/or other such programs of the Commonwealth of Pennsylvania or of the federal government.
Any person or persons violating the provisions of this article or later amendments or the regulations shall be asked to leave the area. If violators refuse to leave the area after one warning, the violators shall be immediately ejected from the designated no smoking area. Any person who further violates or permits a violation of this article shall be subject to a civil enforcement proceeding and, upon conviction, shall be sentenced to pay a civil penalty of not more than $600, plus all court costs, including reasonable attorneys' fees, incurred by the Borough in the enforcement of this section. Each day a violation exists shall constitute a separate offense. Further, officers of the Borough of Langhorne Police Department or other designated officials or agents of the Borough are authorized to file a complaint for criminal summary violation to enforce compliance with this section.
In the event that any section, sentence, clause, phrase or word of this article shall be declared illegal, invalid or unconstitutional by any court of competent jurisdiction and such declaration does not negate the intent of this article, said declaration shall not prevent or otherwise foreclose enforcement of any of the remaining portions of this article.
All ordinances or parts of ordinances inconsistent herewith or in conflict with any of the specific terms enacted, to the extent of said inconsistencies or conflicts, are specifically repealed.
