(4) 
Customer receiving water at one location through more than one meter:
a. 
If the city does not have a single meter of sufficient size to meter the water volume of an apartment, commercial, industrial, or large industrial customer and more than one meter must be used to meter the water quantity, the minimum water rate will be applied to one of said multiple meters only.
b. 
Any customer receiving water service at one location or complex through more than one meter will receive only one 20,000 gallon allowance during the summer period, June through September consumption, before the conservation rate is applied.
c. 
A large industrial customer is defined as a business which uses water in the production of a product and has an average consumption of eight million gallons per month or greater. If the customer is receiving water service at one location or complex through more than one meter the total of the meters will be used for the calculation of the monthly average and the rate will apply to all meters serving the complex.
(5) 
City use for firefighting purposes:
Water used by the city for firefighting purposes will not be charged.
(6) 
Rates for municipal purpose water service:
Water service used for municipal purposes that is furnished to property owned by the city may be charged $3.03 per 1,000 gallons of consumption.

(a) 
Multi-unit uses, such as apartments, mobile home parks, hotels, motels, duplex, triplex, and fourplex shall be billed using the water rates for apartments under section 52-1.
(b) 
When a multi-unit use which is also a master metered apartment house, as defined in chapter 8A of this Code for purposes of water service, has water service discontinued for non-payment, the customer shall pay to the city a resident displacement fee of five hundred dollars ($500.00) for each unit affected by the discontinuance of service, which money is to be used to defray the moving costs of residents, and such cost shall be considered an additional penalty. From money gathered from this displacement fee, or money set aside for this purpose, city shall cause to be paid five hundred dollars ($500.00) to the renter of each unit which no longer has water service as a result of the service discontinuance to be applied toward the costs of moving from the master metered apartment complex.

Sewer user's charge for new residential and commercial customers shall be computed on eighty (80) percent of the actual monthly metered water sales until the three (3) winter months' average meter sales is determined, but if said computation is not reasonable according to the information available to the water utilities director or designee, said water utilities director or designee may recompute said charge using data compiled from other similarly situated type of customer.

For each commercial or industrial unit to which sanitary sewerage service is furnished directly or indirectly, and whose use of water is not purchased directly or indirectly from the city, the water utilities director or designee shall determine if a water meter or meters will be installed. The meter installation and maintenance shall be at the expense of the owner and shall be of the type approved by the water utilities director or designee for the purpose of determining the proper volume of flow to be used in computing sewer service charges. Such meters shall be read monthly and tested for accuracy when deemed necessary by said water utilities director or designee. Where it can be shown to the satisfaction of said water utilities director or designee that a substantial portion of the water as measured by the aforesaid meter, or meters, does not enter the sanitary sewer system of the city, then he may require or permit the installation of additional meters at the owner's expense in such manner as to measure the quantity of water actually entering the said sanitary sewerage system from the lot, parcel of land, building, or premises of such owner or occupant.
If the water utilities director or designee determines a meter on a private well or other water source is not practicable, sewer use charge will be determined by the water utilities director or designee based on water used by similar establishments, or in any manner or method he may find practicable in order to arrive at the percentage of water entering the sanitary sewerage system and/or the quality of the sewerage to be used to determine the sewer service charge. The estimated water consumption shall be applied to rates in effect.
For residents without city water service, an amount will be charged monthly based on a specific volume applied to rates in effect. The specific volumes used in the calculation are as follows:

(a) 
General rule.
(1) 
Commercial and multi-family accounts must provide the city with a security deposit before receiving water service.
(2) 
Other accounts, including individual residential accounts, may be required to furnish a deposit prior to receiving water service.
(3) 
Security deposits shall bear no interest and will be returned when the water service is discontinued if all bills have been paid and all other obligations met.
(4) 
Security deposits may be set at two (2) times the average bill for city services, unless service has been discontinued to a location for nonpayment.
(5) 
When service has been discontinued due to nonpayment, the new deposit, along with all associated fees for disconnection and prior amounts due, must be received prior to the restoration of service. A deposit for water service may be adjusted to four (4) times the amount of the highest bill when service has been discontinued to that location due to nonpayment.
(6) 
The minimum deposit for residential services shall be equal to two (2) times the minimum charge for city services. The minimum deposit for apartment, commercial, and industrial services shall be equal to two (2) times the average bill or two (2) times the minimum charge, whichever of the two (2) is greatest.
New multi-family service locations shall be assessed an additional forty-five dollars ($45.00) for each dwelling unit.
(b) 
Exceptions to the requirement of a security deposit or refunds of security deposits for current accounts.
Accounts may be excused from the requirement of a security deposit if the conditions set out in any of the following sections are met:
(1) 
Exception to the requirement of a security deposit for new residential customers over sixty-five (65) years of age. New customers over sixty-five (65) years of age may be excused from the requirement of a security deposit if they present evidence of their age and verification of established credit such as a letter of credit issued by a municipal utility or other utility company verifying that the customer's account is fully paid and there are no more than two (2) delinquent payments during the last twelve (12) months.
(2) 
Other accounts—Exception to the requirement of a security deposit.
This category does not include multi-family master-metered accounts, commercial accounts, or hotels/motel accounts. A new account in this category may be excused from the requirement of a security deposit if all of the conditions set out in at least one (1) of the following subsections are met:
a. 
The customer is establishing a new account and has had an account for similar service with the City of Irving which has been active for a minimum of twelve (12) months and the account is current, the account has not been disconnected during the past twelve (12) months, there have not been more than two (2) delinquent payments during the last twelve (12) months, and there have not been any checks or electronic debits that were dishonored by the customer's bank.
b. 
The customer has had a similar type account within the past three (3) years for a minimum of twelve (12) months and the customer's final bill was paid in full, the service on the account was not disconnected for nonpayment during the last twelve (12) months of service, there were no more than two (2) delinquent payments during the last twelve (12) months of service, and no checks or electronic debits were dishonored by the customer's bank.
(3) 
Refunds for current accounts.
Single-family residential customers who have had their current account with the City of Irving for a minimum of twelve (12) months and who have had no more than two (2) delinquent payments, who have not had any checks or electronic transactions dishonored by the customer's bank, and are not currently delinquent, shall be eligible to have their security deposit refunded by a credit applied to the utility bill.

(a) 
Due date.
All bills for water, sewer, garbage, and other services are due and must be received by the City of Irving, Customer Service Office, before 5:00 p.m. on the due date shown on the bill. The due date is defined as the date shown on the bill, which is twenty-five (25) calendar days from the date bills were mailed.
(b) 
Penalty.
Bills not paid by the due date will be assessed a penalty of ten (10) percent of the total past due balance.
(c) 
Discontinuance of service.
(1) 
The city may discontinue service to any customer with a bill for water, sewer, garbage, or other services which has remained unpaid for more than thirty (30) calendar days past the due date.
(2) 
The city may discontinue service to any customer whose bill includes a deposit and has an unpaid balance on the deposit on the day following the due date as stated on the monthly bill.
(3) 
Service will not be discontinued on a day or the day before a day when personnel are not available to the public for the purpose of making collections and reconnecting service, unless the customer requests immediate disconnection or a dangerous condition exists which requires an immediate disconnection.
(d) 
Unless ineligible to receive a certificate of occupancy, service will be resumed to any person, firm, corporation, or customer whose service has been discontinued upon payment of the overdue bill, plus the ten (10) percent penalty, plus payment of the applicable deposit, plus an additional amount to recover the cost of disconnecting and resuming service as follows:
(1) 
Twenty-five dollars ($25.00) if balance of account is not paid in full by 5:00 p.m. the day before the cut off date noted on the bill.
(2) 
Fifty dollars ($50.00) for each field contact related to the nonpayment of services resulting in locking the meter or the removal of the meter or any unauthorized device being used to obtain water illegally.
(3) 
Additional charges equal to the cost of parts and labor will be assessed to a customer for damage to the meter, locking device, and/or connection resulting from an attempt to reconnect water service by anyone other than a city employee.
(4) 
Fifty dollars ($50.00) for a request to resume services outside of normal operating hours, to be paid prior to reconnection of service or shall be added to the customer's account.
(5) 
Fifteen dollars ($15.00) for each attempt, in excess of two (2), to reconnect services shall be added to the customer's account.
(e) 
Additional charges may be assessed as part of the city's attempts to recover charges and penalties due. These charges are as follows:
(1) 
Fourteen dollars ($14.00) for each nonfield contact initiated by city personnel related to the nonpayment of services including the mailing of both certified and noncertified letters and the posting of notification of scheduled disconnect for nonpayment.
(2) 
One hundred sixty dollars ($160.00) for costs associated with recording notices of lien for delinquent utility services as provided for in section 41-11.
(3) 
Thirty-six dollars ($36.00) for costs associated with recording a release of lien upon recovery of delinquent charges and penalties.
(4) 
Penalties or fees associated with the recovery of utility bill charges through the service of a collection agency employed by the city.
(5) 
Resident displacement fees of five hundred dollars ($500.00) per unit for each unit affected by a discontinuance of water service for nonpayment and which is occupied on the date the service is discontinued. Such fees shall be waived for each unit where the residents did not move out provided the building inspector affirms in writing, within forty-eight (48) hours of the discontinuance, that the multi-family complex has been brought up to code and is eligible to receive a certificate of occupancy.

Any consumer shall have the right to demand that the meter through which water is being furnished be examined and tested for accuracy. Such consumer shall make application in writing and with such application shall agree to a fee of forty dollars ($40.00) to be added to the consumer's water bill. In the event such inspection reveals said meter was registering inaccurately or was misread, said forty dollars ($40.00) shall be waived and adjustment made for the inaccurate reading.
Any consumer shall have the right to demand that the meter reading be checked for accuracy. In the event such inspection reveals said meter was read correctly, a fee of seven dollars ($7.00) shall be assessed.

The City of Irving shall hold the consumer liable for all water registered on said consumer's meter and shall not make any adjustment onto consumer's account for leaks or other reasons, which would alter the registered gallonage on said meter. However, when leak is a concealed leak, there may be one (1) adjustment made in favor of customer per year on the following basis. Customer must present proof that the leak was repaired and the bill will be then computed as follows: Three-month average monthly bill immediately preceding the leak plus actual cost of water purchased from City of Dallas by city shall be charged to customer.

If the meter is not registering due to malfunction or due to any circumstances and it is impractical to read, meter usage may be estimated.

(a) 
It shall be unlawful for any person to make a connection to City of Irving's water or sanitary sewer systems without first securing approval from the appropriate department of the City of Irving.
(b) 
It shall be unlawful for any person to use City of Irving water or sanitary sewer service without paying for such service.

Any customer making payment of their monthly bill by a check which is returned by their bank shall be assessed a fee in accordance with the city financial policies and purchasing procedures.

A customer may enter into a payment agreement with the city no more than two (2) times per calendar year. This agreement provides for payment installments to be made against the customer's account for up to three (3) months, unless otherwise authorized by the water utilities director or designee and is subject to interest charges of six (6) percent. If the customer fails to meet the terms of the payment agreement, water service will be discontinued and will not be restored until the past due amount plus other applicable charges are paid in full.

A connection charge shall be assessed to any person receiving services upon application for initial commencement of service, or upon application for any transfer of service from one (1) name or address to another. Such fee is a nonrefundable fee to cover the cost of establishing service. If more than one (1) account is involved in an initial establishment or subsequent transfer, the fee shall be paid for each account involved. The fee shall be assessed as follows:

Such fee(s) shall be paid by each applicant for service or transfer of service at the time of submission of such application, and prior to connection or transfer of service; or shall be added to the customer's account. A fee of fifteen dollars ($15.00) for each attempt, in excess of two (2), to connect services shall be added to the customer's account.
