The Council may, by majority vote of those present and voting, employ any person or persons as officers of the City, at such salaries or wages as may be set by the Council, on a permanent or indefinite basis without such person or persons having first been temporarily employed by the Mayor. The following are considered officers of the City: Police Chief, Fire Chief, City Clerk, City Treasurer, Personnel Director, and Purchasing Agent.

(a) 
The Mayor may remove temporarily any officer of the City except those elected by the people or whose term is set by law, for good cause. He or she shall give the officer written notice of the next Council meeting and shall report such removal and his or her reasons therefor to the Council at its next regular meeting at which time the officer may be heard and when, if the Council shall sustain the act of removal by the Mayor by a majority vote of those elected to the Council, the vacancy so created shall be filled as herein provided.
(b) 
No other official of the City shall have the power or authority to remove an officer of the City except as herein provided. The Council, for good cause, after first giving the individual notice in writing and an opportunity to be heard, by two-thirds majority vote of those elected to the Council shall have the authority to remove any officer of the City except those elected by the people or whose term is set by law, without such officer having been temporarily removed by the Mayor.

If the Council shall, at its regular meeting, fail to take action on a report by the Mayor of the removal of an officer, unless expressly tabled to a time and date certain by majority vote of the Council present and voting, the removal shall stand.

If the Council shall, by vote, fail to sustain the temporary removal of such person or persons by the Mayor, they shall resume their positions and be entitled to all back pay from the time of such removal to the vote of the Council.
