The City Engineer is hereby authorized to designate not more than one marked parking space within any City block for the exclusive parking of motor vehicles of disabled persons. Such spaces shall be marked with distinctive signage as required by state or federal law.

A license plate or placard issued to a disabled person in accordance with Alabama Code § 32-6-230 et seq. shall grant to the holder thereof the right to use any parking space designated for the use of disabled persons by the City Engineer; provided, however, that the possession of this license plate or placard shall in no way exempt the operator of any such vehicle from obedience to any other ordinance or law prohibiting the standing, stopping or parking of motor vehicles upon any public street.

It shall be unlawful for any person not displaying a license plate or placard as herein provided to park any vehicle in an area designated for parking by disabled persons; provided, however, that if it appears that the driver of or a passenger in such motor vehicle would be eligible for such license plate or placard but for a failure to apply therefor, the first charge made against such person hereunder shall be dismissed upon such person reasonably satisfying the judge trying the case thereof.

Upon the request of the owner, the City Engineer is also authorized, in addition to the above, to designate certain parking spaces in parking decks or privately owned parking lots and to authorize those spaces to be posted as parking for disabled persons under the provisions of this division. The parking spaces so designated in parking decks or privately owned parking lots shall be marked in the same manner and be subject to the same regulations as provided in this division. The cost of the sign and/or installation by the City shall be paid to the City Treasurer by the owner prior to delivery or installation of any such sign. In any prosecution for the violation of any provision of this division relating to the operation or parking of vehicles, it shall be prima facie evidence that the owner of that vehicle was operating the same at the time of the alleged violation and that the owner parked the vehicle.

Any person found guilty of a violation of this division shall be punishable as provided in Alabama Code § 32-6-233.1.
