Upon the request of the owner, the City Engineer is also authorized, in addition to the above, to designate certain parking spaces in parking decks or privately owned parking lots and to authorize those spaces to be posted as parking for disabled persons under the provisions of this division. The parking spaces so designated in parking decks or privately owned parking lots shall be marked in the same manner and be subject to the same regulations as provided in this division. The cost of the sign and/or installation by the City shall be paid to the City Treasurer by the owner prior to delivery or installation of any such sign. It shall be unlawful for any person not displaying a license plate or placard as herein provided to park any vehicle in an area designated for parking by disabled persons; provided, however, that it if appears that the driver of or a passenger in such motor vehicle would be eligible for such license plate or placard but for a failure to apply therefor, the first charge made against such person hereunder shall be dismissed upon such person reasonably satisfying the judge trying the case thereof.
