The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
ABANDONED MOTOR VEHICLE
Means a motor vehicle located on private property for a period of 30 consecutive days which is:
(1) 
Inoperative and no longer intended to be rendered operative; or
(2) 
Unregistered and not in condition for legal use on the public highways and is in such condition as to create an adverse effect upon the public landscape or nearby private or public property or otherwise creates a public nuisance, safety or health hazard.
DISCARDED MOTOR VEHICLE PARTS
Means used parts of motor vehicles or old iron, metal, glass, paper, cordage or other waste discarded or second hand material which has been part or is intended to be a part of any motor vehicle located on private property for a period of 30 consecutive days, provided that any such parts or materials are not lawfully stored within a garage, building or structure.
MOTOR VEHICLE
Means any vehicle propelled or drawn by any power other than muscular, to include but not be limited to automobiles, trucks, busses, tractors, trailers, motorcycles and like vehicles.

Any owner of an abandoned motor vehicle or of discarded motor vehicle parts or any owner of property or person in possession of property on which an abandoned motor vehicle or discarded motor vehicle parts are located may be subject to a fine of not less than $40.00 and not more than $100.00, 30 days after the Town has given written notice to remove to such owner or person as provided. In addition to any other available remedies, fines may be imposed pursuant to a citation issued by the Chief of Police or his designee.

This article shall not apply to abandoned motor vehicles and discarded motor vehicle parts located in a motor vehicle junkyard licensed in accordance with G.S. § 14-67g - r or permitted under any exemptions to such licensing requirements.

Abandoned motor vehicles and discarded motor vehicle parts are prohibited within the limits of the Town.

When it is determined that an abandoned motor vehicle or discarded motor vehicle parts are located on private property, the Town shall notify the person in possession or control of such property, and also the owner of said vehicle or parts, if known, in writing by registered or certified mail, to cause removal of such vehicle or parts, and shall also provide for notice in a newspaper having a substantial circulation in the Town. If such owner or person has not caused removal of such vehicle or parts within 30 days after receipt of said notification, the Town may cause removal of such motor vehicle or parts to a licensed junkyard or to an area authorized by the proper authority for impoundment and disposal of such vehicle or parts. The Town shall collect the cost incurred in removing and disposing of any such vehicle or parts from the owner of such vehicle or parts or from the party in possession or control of the property or the owner of the property from which removal was made.

Prior to removal of abandoned motor vehicles as provided for in Section 17-25, the Chief of Police shall notify the State Motor Vehicle Commissioner of the issuance by the Town of the removal notice, such notification to include the location of the vehicle, the identification number if available and such other description or identification of the vehicle as may assist in establishing the legal ownership of the vehicle.
