A.
Minor subdivision application filing requirements.
(1)
Minor subdivisions may be filed and processed in accordance with the standards and requirements in this section, provided the following criteria are met:
(a)
A subdivision proposal which would divide one existing lot into not greater than three lots, each of which will comply with the applicable dimensional requirements of the zoning district in which the existing lot is located.
(b)
The existing lot has sufficient frontage on an existing, improved public street to satisfy the applicable Township requirements for lot frontage and access to a public street for each proposed lot.
(c)
The existing lot has not been a part of an approved subdivision proposal during the five years prior to the current application.
(d)
The subdivision will not require new road construction, road improvements, or the extension of existing public utility lines.
(e)
The proposal will not involve significant stormwater and/or erosion control issues, as determined by the Township Engineer.
(2)
The Township Planning Director may exempt the plan for review by the Planning Commission and Council if:

If the Township Planning Director exempts a plan from review by the Township Planning Commission and Council, the Township Planning Director shall issue an approval or disapproval within 60 days after an administratively complete submission of the plan to the Township. If the sixty-day time period is exceeded without a decision by the Township Planning Director, the plan shall be deemed approval unless the applicant and Township Planning Director agree upon a different time period in which to make a decision on the minor plan. Any such decisions and findings upon which they were based shall be documented and transmitted to the Planning Commission and Council at their next regularly scheduled meeting.
B.
Minor land development application filing requirements.
(1)
In the case of a land development application consisting of an expansion of an existing structure or use may be processed as a minor land development if the following criteria is met:
(a)
The proposed expansion amounts to no more than a 5% increase in gross floor area or 5,000 square feet, whichever is less; and
(b)
The proposed plan does not increase impervious surface 1,000 square feet or more of additional impervious surface; and
(c)
The gross floor area and impervious surface area calculations do not exceed those noted above when including any other prior minor plan expansions.
(2)
The Township Planning Director, in consultation with the Township Engineer and the Township Zoning Officer, may exempt a plan from review by the Township Planning Commission if:
(a)
The plan complies with the standards contained in this chapter and other applicable ordinances.
(b)
The plan does not require waiver or modification of the requirements of this chapter and does not require a zoning variance.
(c)
The plan does not propose a use requiring special exception or conditional use approval.
(3)
If the Township Planning Director exempts a plan from review by the Township Planning Commission, the Township Planning Director shall issue an approval or disapproval within sixty-days after an administratively complete submission of the plan to the Township. If the sixty-day time period is exceeded without a decision by the Township Planning Director, the plan shall be deemed approval unless the applicant and Township Planning Director agree upon a different time period in which to make a decision on the minor plan. C.
Submission requirements and review procedure for minor subdivision or land developments. Submission requirements and review procedures for subdivision and land developments plans that meet the requirements to be considered minor plans are set forth as follows:
(1)
All minor plans for the purposes of submission for review and approval shall comply with the applicable requirements of preliminary and final plan submission requirements and review procedure.
(2)
When a minor plan qualifies for approval, or for approval subject to conditions, the minor plan may be granted concurrent preliminary and final plan approvals, provided that the plan includes the final plan certifications.
(3)
A minor plan which will require access to a state highway shall provide the highway access statement on the plan and submit a copy of a PennDOT highway occupancy permit to the Township prior to recording.
