No person shall park any vehicle where prohibited or for a period of time longer than is designated or authorized by official signs.
No operator of any vehicle other than a bus shall stand or park in a bus stop or a taxicab in a taxicab stand officially designated by ordinance or resolution of Council, when marked by appropriate signs, except the operator of any passenger vehicle may temporarily stop in any such stop or stand for the purpose of and while actually engaged in the loading and unloading of passengers.
No operator shall stop, stand or park any vehicle upon a street or an alley, in such manner or under such conditions as to leave available less than 15 feet of the width of the roadway for free movement of vehicular traffic, except an operator may stop temporarily during the actual loading or unloading of passengers or when necessary in obedience to traffic regulations or traffic signs or signals of a police officer.
A.
In places where, and at hours when, stopping for loading or unloading of merchandise or materials is permitted, vehicles used for the transportation of merchandise or materials may back into the curb to take on or discharge loads, when the owner of such vehicle holds a permit granting him such special privilege. Such permit shall be either in the possession of the operator or on the vehicle at the time such vehicle is backed against the curb to take on or discharge a load. No owner or operator shall violate any of the special terms or conditions of any such special permit.
B.
The Mayor is hereby authorized to issue to any owner of a vehicle used to transport merchandise or materials, a special permit, renewable annually, and to state therein the terms and conditions thereof, allowing the operator of such vehicle the privilege of loading and unloading while the vehicle is backed against the curb, if in the opinion of the Mayor such privilege is reasonably necessary in the conduct of the owner's business and will not seriously interfere with traffic.
No operator of any vehicle shall park such vehicle in double rank.
Whenever traffic and parking rules permit parking for a limited time on any street, it shall be considered a violation of such rules to move the vehicle against which such restrictions run, to another nearby point, or to take such vehicle away and return it to the same or nearby point within a short space of time. In such case, the restricted time shall run from the original parking.
No person shall park any vehicle on a sidewalk or footway of any public street or on any part thereof.

No person shall use any part of any public street or sidewalk to sell, store, repair, or restore, overhaul, reconstruct, recondition or work on any vehicle.
No person shall park any vehicle within 15 feet of any fire hydrant.
A.
No person shall park any vehicle trailer, trailer coach or trailer on any street, alley or highway or other public place or on any tract of land owned by any person, except as provided in this section.
B.
Emergency or temporary stopping or parking of vehicle trailers, trailer coaches and trailers is permitted on any street, alley or highway for not longer than two hours, subject to any other and further prohibitions, regulations or limitations imposed by the traffic and parking provisions of this chapter.
C.
The use of vehicle trailers for dwelling purposes is hereby prohibited. Parking or stopping of vehicle trailers, trailer coaches and trailers on tracts of land owned by any person for storage purposes shall be permitted.

No person shall park a commercial vehicle on any street within 100 feet of any property used partially or completely for residential purposes between the hours of 6:00 p.m. and 6:00 a.m., except for the purpose of loading or unloading vehicles in the usual course of business with the occupants of the residential property, or while carrying passengers for hire.

The Mayor is hereby authorized to permit parking without charge on those City-owned parking lots on such days and for such periods of time as Council shall authorize by resolution.

Except as otherwise provided by law, every vehicle standing or parking upon a two-way highway shall be positioned parallel to, with the right-hand wheels within 12 inches of the right-hand curb. Except as otherwise provided by law, every vehicle standing or parked upon a one-way highway shall be positioned parallel to the curb in the direction of authorized traffic movement, with its right-hand wheels within 12 inches of the right-hand curb, or with its left-hand wheels within 12 inches of the left-hand curb.

No person shall park or leave unattended a vehicle on private property without the consent of the owner or other person in control or possession of the property except in the case of an emergency or disablement of the vehicle, in which case the operator shall arrange for the removal of the vehicle as soon as possible. The provisions of the subsection shall not apply to private parking lots unless such lots are posted to notify the public of any parking restrictions and the operator of the vehicle violates such posted restrictions. For the purposes of this section "private parking lot" means a parking lot open to the public or used for parking without charges, or a parking lot used for parking with charge.

A.
A motor vehicle bearing a handicapped plate, a severely-disabled veteran plate or displaying a valid handicapped parking placard or severely disabled veteran placard and is being operated by or for the transportation of a physically handicapped person or severely-disabled veteran to whom such disabled driver credentials have been issued is Disabled Parking Permitted and eligible to park without limitation as to time in any reserved on-street parking space for physically handicapped person and severely-disabled veteran.

To promote retail businesses, and recognizing the demands of operating a retail business which requires extended hours for the person or persons opening and closing the business, the City hereby establishes a Merchant Parking Zone as follows:
A.
On portions of certain streets in the downtown retail area, as designated below, parking shall be restricted to vehicles enrolled in the Merchant Permit Parking Program.
B.
For each retail business within the retail business zoning district, one non-transferable parking permit may be issued by the City to either the principal of the business or to an employee or associated that the principal of the business designates.
C.
To be eligible for enrollment in the Merchant Permit Parking Program, the business entity must have filed, and have currently paid, the requisite business privilege tax, and must have filed as a "Retail Business," prior to request for enrollment.
D.
The "principal" of a retail business is the individual named at the bottom of the business privilege and mercantile tax return form, as provided by the City of Chester Licensing and Inspection Department.
E.
Merchant Parking Permits are valid for one year from date of issuance.
F.
The areas designated to be within the Merchant Parking Zone and subject to the Merchant Permit Parking Program are as follows:
G.
Signage will be erected to specifically show the spaces designated as part of the Merchant Parking Zone.
H.
Enrollment in the Merchant Permit Parking Program allows the holder of a permit to park in a parking spot for longer than the designated hourly time limit, for up to 72 hours. A permit does not guarantee the holder of the permit a parking spot within the Merchant Parking Zone.
I.
The cost of a permit is $25 per year.
J.
Enforcement of the parking restrictions enumerated herein shall be the responsibility of the Parking Authority or its agent.
K.
Any area designated for Merchant Parking Permits parking shall be identified by signage stating "No Parking Except Zone M Permits."
L.
Each eligible retail business shall only be permitted the issuance of one permit per year per commercial establishment. If a retail business is sound to have multiple permits for a single retail store, Merchant Parking Zone privileges will be revoked for all permits for a minimum of one year.
M.
The Parking Authority shall have the power to create additional requirements and regulations for the Merchant Parking Zone by the passage and adoption of a resolution.

In addition to the powers and authority delegated by § 528-1 to the Parking Authority, the Council hereby authorizes the Parking Authority to adopt rules and regulations related to parking that are not inconsistent with the provisions of the Commonwealth Vehicle Code, this chapter, or the parking code of the City of Chester. Such authority includes, but is not limited to, the right to identify parking hours, rates, rules, and to erect signs related to same, provided that the authority to preclude parking at a particular space or for particular hours shall be non-exclusive with duly authorized City personnel. Any residential parking program designation shall not take effect until it has been approved by City Council.

A.
Eligibility for residential permit parking permits.
(1)
Each residence located within a designated residential permit parking zone ("RPP Zone") shall be eligible for receipt of up to two residential parking permits per household per year.
(a)
Each permit shall be registered to a license plate and are nontransferable.
(b)
The Parking Authority shall establish a program to allow households to apply for an additional third residential parking permit in the event of a unique hardship or other exigent circumstances.
(c)
Commercial vehicles, such as those with repair license plates, dealer license plates, taxis and liveries, and buses, campers and trailers over 20 feet in length, are not eligible for a residential parking permit.
(2)
For purposes of the residential permit parking (RPP) Program, the definition of "household" is as follows:

Vehicles registered in the RPP program shall be excused from observance of time-based parking restrictions only in the RPP Zone for which the residential parking permit is registered; provided that where a parking space is metered, RPP Zone parking is only for hours outside the hours of operation for such meter. Registration under the RPP program shall not excuse non-compliance with other parking restrictions, such as compliance with no-parking areas or parking in an unsafe manner.
B.
Permitting process.
(1)
In order to receive a residential parking permit, a resident must complete and submit a residential permit application. The Parking Authority shall make such application available in an office at City Hall and in such other places and means as the Parking Authority determines. The Parking Authority shall accept applications in an office at City Hall, by first-class mail, and through such other means as the Parking Authority shall determine.
(2)
To be eligible for a residential parking permit, a resident must demonstrate:
(a)
Possession of a valid driver's license;
(b)
A valid vehicle registration; and
(c)
Residency in the specified RPP Zone. Residency may be demonstrated by:

Registration of the vehicle and driver at the specified address within the RPP Zone; or
[2]
Both a copy of a utility bill, credit card statement, insurance statement or recent bank statement issued in the 60 days prior to registration; and a lease or deed or other proof of ownership in the name of the person registering the vehicle, or such lease, deed, or other proof of ownership together with a written authorization from the person named therein. In the event of a dispute over the vehicles or registrants authorized to obtain such a permit, the property owner may, in writing, establish the designee.
(3)
The Parking Authority shall establish a process for permitting of company cars or other non-commercial vehicles owned by employers, subject to proof of authorized use and proof of residency of the authorized user.
(4)
A resident must inform the Parking Authority within seven days of a relocation outside of the RPP Zone, and the Parking Authority shall deactivate the permit upon notification. Any resident using a residential parking permit who is no longer eligible will be subject to a $25 fine for a first occurrence, and a $50 fine for each additional occurrence, or such other penalties as may be set by the Parking Authority.
(5)
The cost of each permit shall be $0 for the initial year of the program, and $25 per year for each year thereafter. The Parking Authority shall set the date of the transition to the $25 fee, and shall have the authority to adjust the amount of such fee.
(6)
Each residential parking permit is valid for one year, but may be renewed.
(7)
A residential parking permit will not be issued to or renewed by any resident who has any outstanding and unpaid parking violations and fines.
(8)
The Parking Authority shall establish a process to allow for changes in account status, including a change in vehicle or the temporary use of another vehicle.
(9)
The Parking Authority shall establish a means of providing no fee permitting for City of Chester vehicles, public service vehicles, and vehicles of deployed active duty military members.
(10)
The Parking Authority shall establish a program for guest/temporary permits, and the rules applicable to same, including a limit on the number of such permits per property.
(11)
The Parking Authority shall establish a process to determine eligibility for residential parking permits for multifamily residential buildings with more than two dwelling units.
C.
Administration and enforcement.
(1)
A holder of a residential parking permit shall not have any resident rights in any RPP Zone other than the one covering the address provided on the residential permit application.
(2)
The Parking Authority shall post signs on each block of each designated RPP Zone.
(3)
RPP Zone hours are Monday through Sunday, from 9:00 a.m. to 9:00 p.m., except for City-designated holidays, or such other hours as may be set by the Parking Authority.
(4)
The Parking Authority may establish a process for authorization of temporary service vehicles providing service to a residence located within a designated RPP Zone, both for interim parking for marked service vehicles and for longer periods of service.
(5)
The Parking Authority shall have the right, by passage of resolution, to amend the existing regulations and requirements, and to adopt additional regulations and requirements, for the RPP Program.
D.
RPP Zones. The Parking Authority shall designate the boundaries of Residential Parking Zones and shall transmit the same to City Council for approval. Such zones shall take effect only upon adoption by City Council resolution.

Except as otherwise provided in the Commonwealth Vehicle Code,[1] whosoever violated any provision of this chapter where a penalty is not provided by any other City ordinance shall be fined not more than $50 and costs, to be collected by summary conviction, and in default of payment thereof shall be imprisoned not more than 10 days.
