The construction of any new sidewalks and the repairing of any existing sidewalks in the township shall be done in conformance with the following specifications, regulations and/or provisions.

The grade to which every sidewalk shall be hereafter laid, constructed or repaired, other than that established in an approved subdivision plan, shall be that fixed and designated by the township.

In all new developments and street construction, the space between the street side of the curb to the street side of the paved edge of the sidewalk, the sidewalk paved width and all driveways over sidewalks shall be in accordance with the specifications in the township's subdivision and land development ordinance [chapter 22]. When repairs and/or replacements are required in existing developed sections of the township where sidewalks have been constructed prior to the date of this part, existing conditions shall be taken into consideration by the township in applying the width and location regulations.

Finished sidewalks in all new developments and repairs or replacements to existing sidewalks shall have a grade from the inner edge of the sidewalk to the outer edge of the curbs in accordance with the specifications in the township subdivision and land development ordinance [chapter 22].

All work done hereunder shall be inspected by the township or its designee.

It shall be the duty of the owner of the land abutting upon any sidewalk to keep it in such repair and condition that it may not be or become dangerous to the welfare and safety of the traveling public. The township shall notify property owners in writing when sidewalks are in need of repair or renewal and the repair or renewal thereof shall be made by the property owners within the time provided in the said written notice, except where the repairs required are of an emergency nature, in which event 48 hours shall be given for completion of the repair and/or renewal. Nothing herein contained shall be construed to place the responsibility of determining when sidewalks may become dangerous to the welfare and safety of the traveling public upon the township. At all times such responsibility shall be solely upon the property owner whose land abuts the sidewalk.

Upon the neglect of any owner or owners of property to reconstruct, repair or replace existing sidewalks in a safe and usable condition, the township may, after notice as herein provided, cause the reconstruction, repair or replacement of said sidewalk to be done at the cost of such property owner or owners and shall collect the cost thereof, together with all charges, expenses and fees, including interest at the rate of 6% per annum, from such owner and/or owners, and may file a municipal lien therefore in the court of common pleas in accordance with the Municipal Claims and Lien Law, 53 P.S. § 7101 et seq., or collect the same by action in assumpsit according to the Acts of Assembly of the Commonwealth of Pennsylvania pertaining thereto.

In the event that the sidewalks in question are controlled and maintained by a homeowners association, then the provisions and requirements in Subsections 1 and 2 above shall be deemed to apply to the said homeowners association and any time the term "owner" or "property owner" appears it shall be deemed to mean the homeowners association.

No owner, tenant or other person, firm or corporation in possession of any real property in the township shall permit snow or ice to remain on any pavement or sidewalk on such property or abutting such property for a period of more than 24 hours after snow or ice has accumulated thereon.
2. 
During the aforesaid twenty-four-hour period, the owner, tenant or other person, firm or corporation in possession of such real property shall remove such snow or ice from the pavement so as to create a pathway on such pavement or sidewalk for pedestrian traffic, which pathway shall be at least three feet in width.
3. 
A separate offense shall be deemed committed each and every day that an owner, tenant or other person, firm or corporation in possession of real property permits ice and snow to remain in violation of Subsection 2 hereof.

In the event that an owner, tenant, or other person, firm or corporation in possession of real property, fails to comply with Subsection 2 hereof and the township determines that the condition is dangerous to the welfare and safety of the traveling public, the township may cause the removal of the snow or ice from the pavement at the cost of the owner, tenant, or other person, firm or corporation in possession of the real property and shall collect the cost thereof, together with all charges, expenses and fees including interest at the rate of 6% per annum, and may file a municipal lien in the court of common pleas in accordance with the Municipal Claims and Lien Law, 53 P.S. § 7101 et seq., or collect the same by action in assumpsit according to the Acts of Assembly of the Commonwealth of Pennsylvania pertaining thereto.

In the event that the sidewalks in question are controlled and maintained by a homeowners association then the provisions and requirements in Subsections 1 through 4 above shall be deemed to apply to the said homeowners association and any time the term "owner" or "property owner" appears it shall be deemed to mean the homeowners association.

In general, the township does not permit or encourage the use of those methods and techniques which concentrate and direct stormwater beyond roof downspouts toward sidewalks and streets, i.e., extended rain conductors. On a case-by-case basis, the township may consider such requests from property owners. If such methods are allowed, then all rain conductors shall be placed underground and consist of pipe material such as cast iron, wrought iron, clay or approved plastics, constructed under the sidewalk and through the curb to the gutter. No open gutters for conducting rain water or drainage of any kind will be permitted to run over top of the sidewalk or curbs. The construction details for all such underground rain conductors shall be submitted to the township engineer for review and comment before the conductors are installed.

No persons or person, firm or corporation shall construct or repair any sidewalk without first applying for and obtaining from the township a permit for the same use. The application shall be made on a form supplied by the township.

The cost of obtaining a permit to repair existing sidewalks shall be established by resolution of the board of supervisors from time to time.

Any person, firm or corporation who shall violate any provision of this part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this part continues or each section of this part which shall be found to have been violated shall constitute a separate offense.

Any and all terms, conditions, specifications, or requirements of this part shall be consistent with the terms, conditions, standards, and specifications as may be established by or in accordance with the Americans with Disabilities Act, CABO/ANSI 117.1, or any other codes, regulations, standards, specifications and administrative requirements as may be adopted or promulgated by the appropriate and authorized agencies to implement the terms and conditions of said act or any amendments thereto as may be hereinafter adopted or implemented by any federal, state, or county regulatory agency as if said standards, conditions, regulations, codes or requirements were incorporated herein at length.
