As used in this article, the following terms shall have the meanings indicated:
CANADA GEESE
Wild geese (Branta canadensis) also known as "Canadian geese," having a black head and neck, white cheeks, white under its chin, and a brown body, that nests near water.
FEED
To give, place, expose, deposit, distribute or scatter any edible material with the intention of feeding, attracting or enticing Canada geese.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.
A. 
No person shall feed, cause to be fed, or provide food for Canada geese in any public park or on any other property owned or operated by the Borough of Fair Lawn.
B. 
No person shall feed, cause to be fed, or provide food for any Canada geese within the Borough of Fair Lawn on property either publicly or privately owned.
The Police Department, Code Enforcement Officer and Health Officer are hereby authorized and directed to enforce the provisions of this article.
Any person who violates or neglects to comply with any provisions of this article or any rule or regulation promulgated thereto shall:
A. 
Be given a written warning for a first offense.
B. 
Be issued a summons for any subsequent offenses, which shall be punishable, upon conviction thereof, by a penalty as provided in Chapter 1, General Provisions, Article III, General Penalty Provisions, of the Code of the Borough of Fair Lawn 2000.
