The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
(a) Bicycle: Any device upon which a person may ride which is propelled by human power through a system of belts, chains or gears, having one or more wheels.
(b) Bicycle Plate: The license tag or decal designated by the State in accordance with California Vehicle Code §
39001 to be permanently affixed to the bicycle and which bears a unique number permanently assigned to that bicycle by the State.
(c) Electric Bicycle: An electric bicycle is a bicycle equipped with fully operable pedals and an electric motor of less than 750 watts, and is categorized by the following:
(1) Class 1 electric bicycle is equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches a speed of 20 miles per hour.
(2) Class 2 electric bicycle is equipped with a motor that may be used exclusively to propel the bicycle, and that is not capable of providing assistance when the bicycle reaches a speed of 20 miles per hour.
(3) Class 3 electric bicycle is equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches a speed of 28 miles per hour. This bicycle is equipped with a speedometer.
(d) Motorized Bicycle: Any two-wheeled or three-wheeled device having fully operative pedals for propulsion by human power, or having no pedals if powered solely by electrical energy, and an automatic transmission and a motor which produces less than four gross brake horsepower and is capable of propelling the device at a maximum speed of not more than 30 miles per hour on level ground.
(e) Off-Highway Vehicle: Any two, three, or four wheeled device with no pedals that attains speeds of greater than 20 miles per hour or 750 watts of power that is illegal to operate on a public roadway. This include vehicles commonly referred to as electric motorcycles, all-terrain vehicles, or dirt bikes.
