The purpose of a boundary line adjustment is either to adjust the boundary lines separating two or more contiguous lots of record or to combine two or more lots of record into one or more lots, all of which comply with the provisions of this chapter.

The applicant shall submit for a boundary line adjustment using forms provided by the director. The director shall prepare a submittal checklist providing a list of the application materials that shall be considered the minimum necessary to constitute a complete application.

A boundary line adjustment shall be approved as a matter of right unless the director finds that the boundary line adjustment would:
A. 
Create any additional lot, tract, parcel, site or division;
B. 
Reduce the setbacks of existing structures below the minimum required by code or make existing nonconforming setbacks of existing structures more nonconforming than before;
C. 
Result in a lot that does not meet the minimum dimensional requirements for lot width as set forth in BLMC Title 18;
D. 
Result in a lot wholly encumbered by critical areas, unless the adjustment is for the purpose of creating a lot to preserve the critical areas and will be deeded to the city;
E. 
Diminish or impair drainage, water supply, existing sanitary sewage disposal, or access or easement for vehicles, utilities, or fire protection for any lot, tract, parcel, site or division;
F. 
Increase the nonconforming aspects of any existing nonconforming lot relative to the zoning and land use regulations; provided, that this provision shall not be construed to require correction or remedy of preexisting nonconformities or substandard conditions.

A. 
The director, having reviewed the boundary line adjustment for conformance with BLMC § 17.30.040, shall sign the boundary line adjustment documents indicating the city's approval of the adjustment.
B. 
A note shall be provided on the face of the boundary line adjustment stating that approval of a boundary line adjustment shall not guarantee that future permits will be granted for any structure or development within a lot affected by the boundary line adjustment.

It shall be the responsibility of the applicant to file the approved boundary line adjustment, bearing on its face all required signatures and certifications, with the county auditor and to complete the process and provide an approved copy of the signed and recorded document to the city.
