There are hereby established the following fees for public admission to, use of, and membership in the Harlingen Arts and Heritage Museum.
(1) 
The following admission fees, which entitle a person to tour the Harlingen Arts and Heritage Museum and visit exhibits during a one day operation, are as established in the city fee schedule in chapter 18:
a. 
Adults (19 years or older).
b. 
Seniors (55 or older) and Winter Texans.
c. 
Children (5—18) and students (any age with a full-time student I.D.).
(2) 
The Harlingen Arts and Heritage Museum may be rented in compliance with the Harlingen Arts and Heritage Museum Board policies, as approved by the city commission.
(3) 
Membership in the Harlingen Arts and Heritage Museum Association entitles all members to free admission.
(4) 
The Harlingen Arts and Heritage Museum shall establish requirements for and levels of membership in the Harlingen Arts and Heritage Museum Association.
(5) 
The museum curator, in accordance with policies enacted by the Harlingen Arts and Heritage Museum Board, shall have the authority to grant free admission to individuals or groups for professional and promotional purposes.
(6) 
The Harlingen Arts and Heritage Museum may sponsor special events, programs and/or exhibitions and establish appropriate fees to be set by the Harlingen Arts and Heritage Museum Board.

The Harlingen Arts and Heritage Museum Board shall consist of nine members. Each appointee to the board shall be at least 18 years of age and must reside or work or operate a business within the city limits. The mayor and commission shall each appoint a member to serve on the board for a total of six members. The board members themselves shall elect, by majority vote, three members who must meet the age and residency requirements. The board members shall also appoint two alternates who shall attend the meetings, participate in the discussion and vote only if his presence is needed for a quorum. A quorum shall consist of five members. All appointees must be of good moral character and demonstrate an interest in the general welfare of the city. The terms of office of the current members of the Harlingen Arts and Heritage Museum Board shall expire on December 18, 2004. Thereafter, the mayor and each commissioner shall appoint one member to the board who meets the age and city residency requirements. The board will also appoint three members to the board who meet the age and city residency requirements. The board members will then draw lots to determine who will serve a one year term, who will serve two year terms and who will serve three year terms. No board member may serve more than two consecutive terms. In the event the museum board elected the member, the board itself shall then elect replacement who shall serve the remaining term of the vacating board member. The museum board shall elect from its membership a chairperson, who shall not vote, except when necessary to break a tie. Each appointee shall continue to serve until a successor is appointed. An appointee shall forfeit his office if such appointee fails, without valid excuse, to attend three consecutive meetings. The city manager and museum director shall serve as ex officio board members.

The powers and duties of the Harlingen Arts and Heritage Museum Board shall be:
(1) 
To determine and establish the general policies and program for the operation, conduct, and management of the Harlingen Museum System, and to operate, maintain, extend, and improve the facilities of the Harlingen Museum System, which initially shall be comprised of the Harlingen Museum buildings located and situated at the former Harlingen Air Force Base and the Lon C. Hill Residence Home located and situated in Fair Park, in the city; provided, however, that the board shall not have authority to establish or regulate fees charges by the museum system.
(2) 
Once each year to submit to the city manager a recommended proposed budget for the Harlingen Museum System for the ensuing fiscal year.
(3) 
To accept and receive for the use and benefit of the Harlingen Museum System all donations, gifts, and bequests contributed or devised thereto, whether for a special or stated purpose or for the general use of the system and to advise in the disbursement, investment, or expenditure of such funds which shall be deposited with the city treasurer and disbursed by him in accordance with established ordinance and Charter requirements.
(4) 
To make recommendations to the city commission for action on its part for the benefit of the Harlingen Museum System.
(5) 
To submit at least one report annually to the city commission of the activities, work, and operation of the Harlingen Museum System.
(6) 
To be responsible for financial development fund raising, acquisition, and enhancement of museum resources.

Upon the appointment of the museum board and during its continuance, such board shall formulate and maintain such bylaws, rules and regulations for the conduct of its meetings and its organization and for operation of the Harlingen Arts and Heritage Museum as shall be deemed necessary by such Harlingen Museum Board for the prompt and efficient conduct of the business of such board and the operation of the Harlingen Arts and Heritage Museum.

The Harlingen Arts and Heritage Museum Board shall be responsible to the city commission for the efficient and proper operation of the Harlingen Museum System.
