This article shall be cited as the "Harlingen Abandoned and Junked Motor Vehicle Ordinance."

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Abandoned motor vehicle
means a motor vehicle that:
(1) 
Is inoperable, is more than five years old, and has been left unattended on public property for more than 48 hours;
(2) 
Has remained illegally on public property for more than 48 hours;
(3) 
Has remained on private property without the consent of the owner or person in charge of the property for more than 48 hours;
(4) 
Has been left unattended on the right-of-way of a designated county, state, or federal highway for more than 48 hours;
(5) 
Has been left unattended for more than 24 hours on the right-of-way of a turnpike project constructed and maintained by the Texas Turnpike Authority Division of the Texas Department of Transportation or a controlled access highway; or
(6) 
Is considered an abandoned motor vehicle under Texas Transportation Code § 644.153(r).
Demolisher
means any person whose business is to convert a motor vehicle into processed scrap or scrap metal, or otherwise to wreck or dismantle motor vehicles.
Garage keeper
means any owner or operator of a parking place or establishment, motor vehicle storage facility, or any establishment for the servicing, repair, or maintenance of motor vehicles.
Junked vehicle.
(1) 
The term "junked vehicle" means a vehicle that is self-propelled and is:
a. 
Wrecked, dismantled or partially dismantled, or discarded; or
b. 
Inoperable and has remained inoperable for more than 72 consecutive hours, if the vehicle is on public property; or 30 consecutive days, if the vehicle is on private property.
(2) 
The term "junked vehicle" includes a motor vehicle, aircraft, or watercraft. The definition of "junked vehicle" applies only to:
a. 
A motor vehicle that does not have lawfully attached to it an unexpired license plate and a valid motor vehicle inspection certificate.
b. 
An aircraft that does not have lawfully printed on the aircraft an unexpired federal aircraft identification number registered under Federal Aviation Administration aircraft registration regulations in 14 CFR 47.
c. 
A watercraft that does not have lawfully on board an unexpired certificate of number and is not a watercraft described by Texas Parks and Wildlife Code § 31.055.
Motor vehicle
means any motor vehicle subject to registration pursuant to the Texas Certificate of Title Act (Texas Transportation Code ch. 501).
Police department
means the police department of the City of Harlingen. The term "police department" includes code enforcement officers.
Storage facility
means a garage, parking lot, or any type of facility or establishment for the servicing, repairing, storing, or parking of motor vehicles.

Authorized agents of the police department may enter upon private property for the purpose specified in this article to examine vehicles, or parts thereof, obtain information as to the identity of vehicles and to remove or cause the removal of the vehicle or parts thereof declared to be a nuisance pursuant to this article. No person shall interfere with a police officer, the city sanitarian, or the health inspector in the exercising of duties under the provisions of this section.
