Subject to the promulgation of implementing legislation by the Commissioner's Court of Cameron County, Texas, pursuant to provisions of Texas Local Government Code ch. 241, there is hereby created a joint airport land use zoning board, to be known as the Valley International Airport Joint Airport Land Use Zoning Board, which shall have the powers and exercise the duties as set forth in Texas Local Government Code §§ 241.011—241.014 to adopt, administer, and enforce, under the police power airport land use zoning regulations dividing territory into zones and, within such zones, specifying the land uses permitted and the types of structures permitted to ensure compatibility with the operations and use of the Valley International Airport. Each compatible land use regulation adopted by said board shall include a statement that the Valley International Airport fulfills an essential community purpose.

The Valley International Airport Joint Airport Land Use Zoning Board shall be composed of five members, two members to be appointed by the City of Harlingen, and two members to be appointed by the Commissioner's Court of Cameron County, Texas. The fifth member shall be elected by a majority of the members so appointed and said fifth member shall serve as chairperson of said Valley International Airport Joint Airport Land Use Zoning Board.

The two members of the Valley International Airport Joint Airport Zoning Board appointed by the city shall be members in good standing of the Harlingen Airport Board and the Harlingen Planning and Zoning Commission, respectively. The two members of the Valley International Airport Joint Airport Land Use Zoning Board shall also be members of the Valley International Airport Joint Airport Hazard Zoning Board created in article III of this chapter.

The two members of the Valley International Airport Joint Airport Land Use Zoning Board from the City of Harlingen shall be appointed in the following manner: the mayor and the city commissioners of the City of Harlingen shall draw lots to determine which two of them will have the privilege of placing in nomination the name of an individual, qualified as hereinabove provided, to serve on said board. The question of appointment of the individuals so named shall be put to a majority vote of the city commissioners. The two members so appointed shall serve a term co-extensive with their terms on the Harlingen Planning and Zoning Commission and the Harlingen Airport Board, respectively. In the event one or both of the individuals so appointed by the City of Harlingen to said board ceases to be a member of the Harlingen Airport Board or Harlingen Planning and Zoning Commission, as the case may be, or in the event one or both of the individuals so appointed to said board resign or become incapable of serving on said board, the city commissioners and the mayor shall again draw lots in the manner hereinabove provided to fill the vacancy or vacancies on said board created thereby.
