Subject to the promulgation of implementing legislation by the Commissioner's Court of Cameron County, Texas, the Commissioner's Court of Willacy County, Texas, and the Board of Aldermen of Combes, Texas, pursuant to the provisions of Texas Local Government Code ch. 241, commonly known as the Airport Zoning Act, there is hereby created a joint airport hazard zoning board, to be known as the Valley International Airport Joint Airport Hazard Zoning Board, which shall have all the powers and shall exercise all of the duties set forth in Texas Local Government Code §§ 241.011—241.014; provided, however, that said board shall have the authority to adopt, administer, and enforce under the police power regulations dealing only with "airport hazard" and "obstructions" as those terms are defined in Texas Local Government Code ch. 241. Said board shall have no authority to adopt, administer, or enforce airport zoning regulations dealing with the specification of permitted land uses except as incidental to the duty of said board to regulate and prevent airport hazards and obstructions.

The Valley International Airport Joint Airport Hazard Zoning Board shall be composed of nine members, two to be appointed by the City of Harlingen, Texas, two to be appointed by the City of Combes, Texas, two to be appointed by the Commissioners Court of Cameron County, Texas, and two to be appointed by the Commissioners Court of Willacy County, Texas. The ninth member shall be elected by a majority of the members so appointed and said ninth member shall serve as chairperson of the Valley International Airport Joint Airport Zoning Board.

One of the two members of said board appointed by the City of Harlingen must also be a member of the Harlingen Planning and Zoning Commission. One of the two members of said board appointed by the City of Harlingen must also be a member of the Harlingen Airport Board. The two members appointed by the City of Harlingen shall also serve on a board to be known as the Valley International Airport Joint Airport Land Use Zoning Board created in article II of this chapter.

The two representatives from the City of Harlingen to serve on the Valley International Airport Joint Airport Hazard Zoning Board shall be appointed in the following manner: the mayor and city commissioners of the City of Harlingen shall draw lots to determine which two of them shall have the privilege of placing in nomination one individual to serve on said board. The nomination must be confirmed by a majority of the city commissioners present and voting. The two members so appointed to represent the City of Harlingen shall continue to serve on said board for a term co-extensive with their terms on the Harlingen Airport Board and Harlingen Planning and Zoning Commission, respectively. In the event either or both of the members so appointed ceases to be a member of the Harlingen Airport Board or the Harlingen Planning and Zoning Commission, as the case may be, or in the event one or both of the members appointed to the said Valley International Airport Joint Airport Hazard Zoning Board resign their membership on said board or becomes incapable of serving on said board, the city commission shall again draw lots in the manner hereinabove provided to fill the vacancy created thereby.
