The terms used in this part shall have the following definitions:
"Paid parking space"
means a parking space of sufficient size to permit the parking of one vehicle within a paid parking zone.
"Paid parking zone"
means an area where signs, paid parking devices or curb markings indicate that the parking of vehicles shall be controlled, regulated and inspected with the aid of parking payment devices.
"Parked"
means the stopping or standing of a vehicle whether occupied or not, attended or unattended.
"Parking payment device"
includes any device used to accept payment for parking, such as parking meters, pay stations, web applications, mobile devices, or other methods approved by the director of public works or designee, that when an approved method of payment is used to purchase time for parking, the parking session for one or more vehicles is activated.
"Vehicle"
means any device in, or upon, or by which any person or property is or may be transported upon a street or highway except a device which is operated upon rails or tracks.

Under the California Vehicle Code, the county, on the recommendation of the director of public works or designee, shall by ordinance from time to time, establish paid parking zones set forth in Section 10.12.120 to aid in the regulation, control, and inspection of the parking of vehicles and/or to increase utilization and turnover to support local businesses and economic development.
A. 
It is the intent of the county to establish a target occupancy rate of 85% for all paid parking zones based on parking occupancy data. Occupancy rate refers to the percentage of vehicles that occupy the paid parking zone spaces based on the known parking inventory.
B. 
The county, on recommendation of the director of public works or designee, may modify or eliminate paid parking zones.
C. 
Variations. When temporary special parking or traffic conditions require different hours or days of parking restrictions, the director of public works or designee may vary the hours and days during which the restrictions in the paid parking zones shall be in effect, and, when authorized signs are in place giving notice thereof, no person shall stop, stand, or park any vehicle contrary to the direction or provisions of such signs.
D. 
Shared Parking Agreements. The county may establish and enforce paid parking zones on private property through a public-private agreement with private property owners for the purposes of improving the utilization of existing parking supply. Such agreements shall be established by board resolution or by the director of public works or designee if such authorization has been granted by the board and shall also establish the fees for parking in such paid parking zones.

All paid parking zone rates heretofore established shall be and remain in effect, unless otherwise set or adjusted by the county, the director of public works or designee. The county establishes a range of acceptable hourly rates from $0.00 to $8.00, or daily rates from $0.00 to $50.00, and a range of acceptable hours of operation between 6:00 a.m. and 10:00 p.m.
A. 
The director of public works or designee is authorized to adjust hours of operation, rates, and seasonality of each paid parking zone within the ranges specified in an effort to achieve a target utilization rate of 85% occupancy, based upon parking occupancy and turnover data.
B. 
The director of public works or designee is authorized and directed to establish maximum time limits for both fee and non-fee parking spaces located within paid parking zones in order to facilitate long-term and short-term visitor access.
C. 
Days and hours of operation, rates, and maximum time limits shall become effective when such paid parking regulation and hourly rates are displayed upon appropriate signs installed within such paid parking zone and/or are affixed to, located on, or displayed by a paid parking device located within such paid parking zones.
D. 
The director of public works or designee is authorized to establish peak demand rates within any paid parking zone for days predicted to see higher traffic and parking congestion. These rates may be set during, and/or up to 24 hours prior to, the calendar start of the peak demand day(s). Paid parking devices, temporary signage, and the county website shall display the peak demand rate for the duration of the peak demand day(s).

The director of public works or designee shall cause paid parking devices and signage to be installed in all paid parking zones to provide for the efficient control and regulation of the parking of vehicles therein. Each paid parking device shall indicate the period of time that a vehicle may legally be stopped, parked or left standing in the regulated parking space and shall indicate the time period for which payment was deposited and indicate when the lawful parking session for the parking space has expired.

The director of public works or designee shall cause each parking space within a paid parking zone to be marked with white lines or markings designating such parking space. No person shall stop, park or leave standing any vehicle in a paid parking zone in any manner other than wholly within a parking space so designated.

When a vehicle is parked in any space regulated by a paid parking device within a paid parking zone, established in accordance with the provisions of this part, the operator of said vehicle shall, upon entering said parking space or zone, immediately initiate a parking session using a county-approved method of payment, according to the time interval desired within the maximum limit and the posted parking rates, unless the paid parking device indicates at the time such vehicle is parked that an unexpired portion remains of the period of time for which a payment has previously been deposited.

A. 
No person shall stop, park or leave standing any vehicle in a parking space in a paid parking zone at any time during which the paid parking device indicates that the parking space is not legally in use except during such time as is reasonably necessary to initiate a parking session for such parking space.
B. 
No person shall initiate a parking session using any paid parking device for the purpose of increasing or extending the parking time of any vehicle beyond the legal parking time which has been established for the parking space or zone which said paid parking device is regulating.

A. 
Unless otherwise permitted by signs, no person shall stop, stand or park a vehicle in a paid parking zone between the hours designated within the paid parking zone of any day for longer than the prescribed period for such parking space.
B. 
Any vehicle parked at an inoperable or broken parking meter shall be permitted to park for the maximum time period permitted for that parking space within that paid parking zone.

No person shall deposit or cause to be deposited in any paid parking device any defaced or bent coin or any slug, metallic device or other substitute for legal United States coin or bill.

The parking fees for the paid parking zones established in this part shall be in conformance with the latest adopted parking fee schedule.

A. 
The county may establish a "Parking Benefits District" fund (Fund) intended to manage the revenue and expenses of managing and operating paid parking for the specified local area. All net revenues received in a specific local area shall be invested for the same local area.
B. 
The purpose of the Fund shall be the receipt, retention and disbursement of funds received by the department of public works for the formulation, implementation, maintenance, operation, and enforcement of paid parking and parking restrictions. The specific primary authorized use of revenues shall be as follows:
1. 
For the purchase, lease, installation, repair, maintenance, operation, removal, regulation and enforcement of paid parking devices and for the payment of any and all expenses relating thereto.
2. 
For the purchase, installation, and maintenance of related signage.
3. 
For the proper regulation, control, enforcement and inspection of paid parking zones.
C. 
Once funding for the primary authorized use of revenues has been allocated, surplus funding shall be budgeted towards the following uses:
1. 
For funding initiatives related to the safety, beautification, and accessibility of the associated local area.
2. 
For funding initiatives related to transportation mobility improvements to the local area.

A. 
For purposes of construction, remodeling, moving or similarly infrequent activities, paid parking space or spaces in the general vicinity of such activity may be rented for a designated vehicle or vehicles, or a debris box, on a daily basis at the discretion of the director of public works or designee. Renting such a space does not reserve any particular space in the vicinity. Ability to utilize the rental privilege is on an "as available" basis when the renter attempts to find a paid parking space in the vicinity of the activity.
B. 
The renter shall pay in advance for the number of anticipated days of use. The rate for such rental shall be a flat amount per day per paid parking space, or portion thereof, calculated as follows:
Hourly rate x Number of hours of controlled parking = Daily rental rate.
C. 
Failure to pay daily rent for use of any rented paid parking space, occupancy of a rented paid parking space by more than one vehicle or debris box, or by parking an undesignated vehicle in a rented paid parking space shall constitute an infraction punishable by a fine.
