If the owner of the impounded animal or animals fails to claim the same and pay the charge and costs as provided in this chapter, within three days after receiving notice in writing, or within six days from the date of the last publication of the notice, as provided for in CMC §
6.08.040, it shall be the duty of the poundkeeper of the city to offer the animal or animals for sale, after first having given due notice of the time and place of the sale, containing a description of the animal or animals and reciting that the same were found running at large within the city limits of the city, for a period of 10 days, and also by publication of the notice in two successive issues of the official newspaper of the city, and shall apply the proceeds of the sale of the animals first, to the costs and charges of impounding, keeping and selling of the animal or animals, and the balance, if any there be, shall be paid into the city treasury for the use of the city.
