It shall be the duty of the city manager to exercise a general supervision of health and sanitation within the city; to direct and supervise the enforcement of any and all laws, city and state, applicable to the city in the matters of health and sanitation; to order the closing of schools and places of amusement, and business houses, and the prohibition of public gatherings, whenever any such action is deemed necessary to protect the health of the citizens of Nome; to order the quarantine or isolation of persons inflicted with contagious or infectious diseases; to order the correction of unsanitary practices or conditions of any business house or food establishment failing to comply with any such correctional order; and advise the council as to ordinances essential for improvement of health and sanitary conditions.

There is adopted by reference, "Regulations pertaining to the public health in Alaska" as compiled and published currently by the Alaska Department of Health, and such amendments thereto as are lawfully made and promulgated from time to time. Five true copies thereof shall be kept on file in the office of the city clerk for public inspection. All installations, repairs and alterations to physical plants, as therein enumerated, shall, from the effective date of the ordinance codified in this chapter, be performed in accordance with the provisions of this chapter.

(a) 
It is unlawful for any person to operate a restaurant, bar cocktail lounge, tavern, meat market, grocery store, bakery, bottled beverage plant, cannery, cold storage plant, food processing and manufacturing plant, candy kitchen or septic tank pumping service within the city of Nome, Alaska, without first obtaining a permit from the city clerk.
(b) 
All permits issued under this chapter shall expire on the thirty-first day of December of each year, and may be renewed upon application to the city clerk.
(c) 
Application forms shall be available at the office of the city clerk and a fee of ten dollars shall be paid to the city clerk at the time the application is filed, when requirements of this chapter are met.
(d) 
Such permits may be suspended by the city manager, upon violation by the permittee of any provision of the law, or the rules and regulations of the state or city. The permittee shall be provided a hearing in front of the council if he or she demands the same within fifteen days after being notified of the suspension order. The council's decision shall be final.

It is unlawful for any person to import, or in any manner bring into the city, or to store, keep or have for sale in the city, any putrid, diseased or unwholesome meat, fish or food for man or beast, if the same is in a diseased or unwholesome condition not fit to eat.

It is unlawful for any person owning, operating or managing any public bakery, restaurant, coffee shop, snack bar, saloon or other eating places or food establishments to fail to keep the same and the fixtures, tools, implements and utensils thereof in a clean and wholesome condition.

It is unlawful for any person working in or about a public bakery, restaurant, coffee shop, snack bar, saloon or other such establishment or who assists in the preparation of food or drink or handles or assists in handling, the products of any such public place or the ingredients going into such products, to fail to do so in a cleanly manner or to fail to keep himself thoroughly clean.

It is unlawful for any person, while afflicted with or suffering from a communicable disease, to work in the capacity of butcher, clerk, waiter, cook, dishwasher, dispenser or bartender, water carrier, barber, beauty operator, chambermaid and laundry worker, in any meat market, grocery store, produce store, bakery, restaurant, coffee shop, soft drink parlor, liquor dispensary, drugstore, candy stand or any other public place of business where food is served or handled or where such person's employment requires contact, directly or indirectly, with the public.

It shall be the duty of the city manager or a designee to from time to time inspect the stores, workhouses and shops where meat, fish or food products or drink designated for food are kept, stored or sold, and to destroy, or cause to be destroyed, any such meat, fish, food product or carcass which is putrid, diseased or unwholesome, and to that end may inject the same with kerosene and use such other methods as may be appropriate.

The city manager or a designee is authorized to inspect all bakeries, restaurants, bars, coffee shops, lunch counters, or other premises where food or drink is served to the public as often as he may deem necessary to ensure compliance with this code, and to cause the abatement of any unsanitary condition found to exist, the expense to be paid by the owner, and to cause any
such place violating the sanitary provisions of this code or the rules and regulations laid down by the health officer to shut down and remain closed until compliance therewith. In addition, any such violator may be punished as provided in this code.

Any person violating any provision of this chapter shall be guilty of an infraction and upon conviction shall be punishable by a fine of not more than two hundred fifty dollars plus any surcharge required to be imposed by AS 12.55.039.
