The city planning commission is created, and shall be known as the San Jacinto planning commission.

The city planning commission shall consist of five members who shall be appointed by the city council of which two members may be residents of the city's approved and adopted sphere of influence, and three members must be and remain residents of this city as a condition of holding their office.

All members of the city planning commission shall receive for his or her service as such the salary of one hundred seventy-five dollars ($175.00) per month, in addition to reasonable expenses incurred in the performance and discharge of their duties as members thereof, which shall be allowed and paid by the city council.

The term of office of each of the original appointees shall be determined by lot so that the terms of two members shall be for one year, and terms of the next two members shall be for two years and the remaining member for three years. Successors to the original appointees shall serve terms of four years.

If a vacancy in the membership of the city planning commission occurs otherwise than by expiration of term, it shall be filled by appointment for the unexpired portion of the term.

If a member of the city planning commission absents himself or herself, without written permission of the chair of such commission, from all regular meetings of such commission for sixty (60) days consecutively from the last regular meeting he or she attended, his or her office shall become vacant and shall be filled as any other vacancy.

The city council, by a four-fifths affirmative vote of all members thereof, may remove any member of the city planning commission from office before the expiration of his or her term, either with or without cause.

A.
In the event any development project involving a quasi-judicial act by the San Jacinto planning commission for which any legislative act of the city council is also either legally required or proposed by the applicant, the planning commission shall act as an advisory body to the city council only, making a recommendation to the city council on such quasi-judicial act. The city council shall have final approval authority over such quasi-judicial act and shall not be bound by the recommendation of the planning commission. For purposes of this subsection, the term "legislative act" shall include, but not be limited to, the adoption or amendment to any of the following: the city of San Jacinto general plan, any city council ordinance or resolution, the San Jacinto Municipal Code (including the development code), any specific plan, or development agreement. For purposes of this subsection, the term "quasi-judicial act" shall include, but not be limited to, the adoption or amendment of any tentative map, vesting map, parcel map, extension of any tentative map, variance, conditional use permit, site development plan review.
B.
The provisions of subsection A of this section shall prevail over any provision(s) contained within the city's municipal code or development code to the contrary. In the event any such contrary provision requires final action by the planning commission such action by the planning commission shall be limited to making a recommendation to the city council, which shall have final approval authority.
