The purpose of this chapter is to set the policies and procedures for public use of electric vehicle charging stations located in public parking spaces owned or controlled by the city.

"Electric vehicle"
means any vehicle that operates, either partially or exclusively, on electrical energy from an off-board source, that is stored on-board for motive purpose.
"Electric vehicle charging station"
means a parking space located in an on-street or off-street parking facility owned or controlled by the city that is served by battery charging equipment that is publicly available, and its primary purpose is the transfer of electric energy to a battery or other energy storage device in an electric vehicle.
"Electric vehicle parking space"
means any marked public parking space in an on-street or off-street parking facility owned or controlled by the city that identifies the use of the space to be exclusively for the parking and charging of an electric vehicle.

Electric vehicle charging stations may be used by any member of the public, subject to the payment of applicable charges and any posted limitations on hours of operation and length of time a vehicle may be parked in a parking space.
Vehicles parked in electric vehicle parking spaces must be connected to the charging equipment and in the process of charging. Pursuant to CMC 10.12.065, any nonelectric vehicles or trailer parked in a parking space designated for electric vehicles shall be subject to removal under CMC 10.12.060(B), unless otherwise authorized by state law.

A per session fee for charging station use shall be established by the city council by periodic resolution.
The fee shall be cost-based and designed to recoup the operating cost of the charging equipment. For purposes of this subsection, "operating costs" shall include electricity costs related to the charging stations and may include the city's cost of planning and administration, fees charged by vendors for management of the charging stations, maintenance costs, facility enforcement costs and other reasonable costs associated with vehicle charging station operations.

Electric vehicle parking spaces must be indicated by vertical signage identifying the space as a publicly available electric vehicle charging station and indicating that it is only for electric vehicle charging. The signage must disclose all rates associated with a charging session at the point of sale and prior to a user initiating a charging session.
Supplementary signage may be posted at the point of sale to provide additional information including, but not limited to, hours of operation, any limitations on the length of time a vehicle may be connected to the charging equipment, and the amount of the monetary penalty under CMC 10.12.065 for parking in the station while not connected to the charging equipment.
