A. 
All trucks having a total combined gross weight of vehicle plus load in excess of four tons shall be excluded from all streets within the Township, as well as the Field of Dreams Access Drive, 501 Creek Road, as to the entire length, except from those streets which form a part of the system of truck routes upon which trucks are permitted to travel and operate, which streets are more particularly described on Schedule VI, being attached hereto and made a part hereof by reference.
B. 
Nothing in this chapter shall be construed to prevent such trucks from making deliveries of merchandise or other property along streets from which trucks are excluded or from excluding trucks used by public utility companies for the construction, installation, operation or maintenance of public utility facilities, within the Township, from any street in the Township. Emergency vehicles and vehicles, such as buses, engaged in the transportation of students and teams to official events shall also not be excluded from any street or Field of Dreams Access Drive, 501 Creek Road.

A. 
Definition.
ENGINE BRAKING (ALSO KNOWN AS COMPRESSION BRAKING OR JAKE BRAKING)
Shall mean the use or operation of any mechanical exhaust device or engine decompression system designed to aid in the braking, deceleration, or decompression of a motor vehicle, which results in excessive, loud, unusual, or explosive noise.
B. 
Prohibition. It shall be unlawful for the driver of any motor vehicle to engage in engine braking on any public roadway, highway, or street located within the geographic boundaries of the Township of Delanco.
C. 
Exceptions. The provisions of this section shall not apply in the following circumstances:
(1) 
When the use of engine braking is necessary for the health, safety, and welfare of the community, and alternative braking methods are insufficient. It shall be the burden of the driver to show that the engine braking was necessary under this exception.
(2) 
When such use occurs in connection with the operation of authorized emergency vehicles acting in response to an emergency.
(3) 
When the engine braking system is properly muffled and the noise emitted is not distinguishably louder than a standard service braking system.
D. 
Signage. The Township of Delanco is hereby authorized and directed to erect and maintain signs at reasonable locations throughout the Township indicating that engine braking is prohibited and subject to enforcement. The absence of signage shall not be a defense to a violation of this section, provided notice of the ordinance has been properly published and codified.
E. 
Enforcement. This section shall be enforceable by the Delanco Township Police Department or any other duly authorized enforcement authority having jurisdiction within the Township. It shall be unlawful for any reason to violate any part of this section adopted by the Delanco Township Committee.
F. 
Violations and penalties. Any person who violates this section shall be subject to a fine as follows:
(1) 
First offense: $100.
(2) 
Second and subsequent offenses: $200.
