The purpose of this article is to establish regulations associated with the storage, maintenance, and winterization of swimming pools within the Township to address issues associated with stagnant water, noxious or foul odors, and attracting insects/pests to pools that are not in use/operation.
The following definitions, as set forth in § 400-8, shall apply to this article:
SWIMMING POOL, PORTABLE
Pools which are not otherwise permanently installed; do not require water filtration, circulation, and purification; do not exceed a water surface area of 100 square feet; and do not require braces or supports.
SWIMMING POOL, PRIVATE RESIDENTIAL
Includes artificially constructed pools, whether located above or below the ground, having a depth of more than 18 inches and/or water surface of 100 square feet or more; designed and maintained for swimming and bathing purposes by an individual for use by members of his household and guests and which is located on a lot as an accessory use to the detached dwelling and shall include all buildings, structures, equipment, and appurtenances thereto.
SWIMMING POOL, PUBLIC
Any artificially constructed pool other than a private residential swimming pool designed to be used collectively by persons for swimming and bathing purposes, including pools designed as part of any hotel or motel use or any cluster residential development. Public swimming pools shall be further classified into types in accordance with their particular use and shall meet the appropriate design standards as set forth by the National Swimming Pool Institute.
A. 
Swimming pools shall be designed and constructed in accordance with the latest edition of the International Building Code, Section 3109.
B. 
The regulations set forth within § 400-38 of the Township's Land Development Ordinance are incorporated herein by reference.
C. 
All portable and private residential swimming pools must be treated with appropriate chemicals to prevent the accumulation of stagnant water, breeding of mosquitoes, aquatic insects, amphibians, and any noxious or foul odors.
D. 
No individual shall be permitted to maintain portable or residential swimming pools where the accumulation of debris and/or liquids could cause offensive odors that can endanger the health, safety, and general welfare of the public.
E. 
All portable and private residential swimming pools that are not in use/operation shall be covered with a suitable, strong protective covering, securely fastened or locked in place to prevent the breeding of insects and algae growth as a source of odors. No individual shall maintain swimming pools, or any open container, in such a manner as to cause stagnant water that may cause the breeding of mosquitoes or insects. A cover shall be considered to be of sufficient strength and securely fastened or locked in place if, when fastened or locked in place, it can support a minimum weight of one (100) pounds.
F. 
Any nuisance which may exist or develop in or as a consequence of any portable or private residential swimming pools shall be abated and/or removed by the owner of said swimming pools immediately upon receipt of a notice of violation of this Article.
A. 
Any person, firm, corporation, or association violating any of the provisions of this Article shall upon conviction thereof be subject fines and penalties as outlined within Chapter 1, General Provisions, Article III, General Penalty, of the Township Code.
