The purpose of this chapter is to provide funding for transportation improvements that preserve, maintain, and, as appropriate, construct or reconstruct the transportation infrastructure of the Town of Woodway, consistent with Chapter 36.73 RCW.

There is created a transportation benefit district to be known as the Woodway Transportation Benefit District (the “District”) with geographical boundaries comprised of the corporate limits of the Town as they currently exist or as they may exist following future annexations.

A. 
The Woodway Town Council shall be vested with the authority to exercise all statutory powers set forth in Chapter 36.73 RCW and this chapter.
B. 
The Woodway Town Council shall develop a material change policy to address major plan changes that affect project delivery or the ability to finance the plan, pursuant to the requirements set forth in RCW 36.73.160(1).
C. 
The Woodway Town Council shall issue an annual report, pursuant to the requirements of RCW 36.73.160(2).

The Town shall have and may exercise all powers and functions provided by Chapter 36.73 RCW, including the imposition of taxes, fees, charges, and tolls set forth in RCW 36.73.040(3), as enacted or subsequently amended.

The funds generated by the exercise of powers granted by Chapter 36.73 RCW may be used for any purpose allowed by law, including, but not limited to, preservation, maintenance, construction, reconstruction, and operation of the Town’s transportation infrastructure, facilities, systems, programs, and “transportation improvements” as defined in RCW 36.73.015(6). Allowable purposes also shall include improving the safety, performance, and security of such infrastructure, facilities, systems, programs, and improvements, and all other purposes consistent with the requirements of Chapter 36.73 RCW, as enacted or subsequently amended.[1]
