[HISTORY: Adopted by the Borough Council of the Borough of Lansdowne 9-12-1955 by Ord. No. 763. Amended in its entirety 7-16-2025 by Ord. No. 2025-05. Subsequent amendments noted where applicable.]
The following are hereby designated as Municipal Parking Lots of the Borough of Lansdowne:
A. 
Municipal Parking Lot No. 1, 32 North Lansdowne Avenue (also referred to as N. Lansdowne Avenue Lot West).
B. 
Municipal Parking Lot No. 2, Baltimore Avenue, by Borough Hall.
C. 
Municipal Parking Lot No. 3, Madison Avenue, south of Borough Hall.
D. 
Municipal Lot No. 4, south side of Lansdowne Theater Building (also referred to as N. Lansdowne Avenue Lot East).
E. 
Municipal Parking Lot No. 5, Highland Avenue.
The Borough Manager shall direct the painting or otherwise placing of lines or markings upon the surface of any Municipal Parking Lot for the purpose of designating individual parking spaces. Each individual parking space shall be not less than eight feet in width.
Each parking kiosk installed on any Municipal Parking Lot shall indicate by a proper legend the legal parking time established by the Borough for such Municipal Parking Lot and, when operated, shall indicate the duration of the period of legal parking and upon expiration of such period shall designate illegal or over-parking.
A. 
It shall be unlawful for the owner or operator of a vehicle of over one-ton capacity to enter upon or park upon any Municipal Parking Lot, with the exception of vehicles serving the Lansdowne Theater building located at 31 N. Lansdowne Avenue, which may enter and park on Municipal Parking Lot Nos. 4 and 5.
B. 
It shall be unlawful for the owner or operator of any vehicle of one-ton capacity or less to park such vehicle upon any Municipal Parking Lot in violation of the provisions of this chapter except that no fee shall be charged upon Sundays and the following legal holidays: January 1, Memorial Day, July 4, Labor Day, Thanksgiving Day and December 25; and in the event that any of said legal holidays occurs on a Sunday, then the provisions of this chapter as to violation shall be inoperative on the Monday following such legal holiday.
C. 
The aforesaid periods of free parking shall commence at 12:00 midnight according to Eastern standard time or according to daylight saving time, whichever is in customary use in the Borough of Lansdowne at the time of the parking, and shall end at the following midnight according to the same time standard.
It shall be unlawful and a violation of this chapter to park any vehicle in a Municipal Parking Lot other than entirely within the lines or markings of an individual parking space.
Except as provided in § 231-8, when any vehicle shall be parked in any parking space in a Municipal Parking Lot where a kiosk is located during the time of limited parking, the owner or operator of such vehicle shall, upon entering the said parking space, immediately deposit or cause to be deposited in said kiosk such payment in the form of notes or credit card. Where kiosks are installed for use in Municipal Parking Lots, payment for parking may also be made via approved smartphone application or text-to-park service, as Borough Council may establish from time to time. Failure to make such payment shall constitute a violation of this chapter. Upon deposit of such payment, such individual parking space may be occupied lawfully by such vehicle for 60 minutes for every $1; provided, however, that no payment shall entitle any vehicle to occupy an individual parking space for longer than the period permissible for the total of such payment so deposited or in any event for longer than a period of 10 hours. If any vehicle shall remain parked in any individual parking space for such a length of time that signal that the lawful parking period has expired, such vehicle shall be considered as parking overtime and in violation of this chapter.
Permits permitting overnight parking of motor vehicles from 10:00 p.m. to 8:00 a.m. for Municipal Lot Nos. 1 and 5 may be obtained from the Police Chief upon payment of a fee as set forth from time to time by resolution of the Borough Council to the Police Chief. Such permits are valid for a period of one month from the date of issue. All other provisions of this chapter (except insofar as § 231-7 shall require the deposit of payment during the hours from 10:00 p.m. to 8:00 a.m.) apply to overnight parking.
Parking in Municipal Parking Lot No. 2 is provided free of charge but is strictly limited to authorized Borough personnel and visitors to Borough Hall, as indicated by signage at each designated parking space. No parking kiosk is installed in this lot. Unauthorized vehicles parked in violation of these restrictions are subject to ticketing and may be towed at the owner's expense. All other provisions of this chapter shall apply.
There shall be no kiosks installed in Municipal Lot Nos. 3 and 4. Payment for parking in these lots shall be made exclusively through an authorized smartphone application or text-to-park service, as Borough Council may establish from time to time, as specified on posted signage within the lots.
A. 
It shall be the duty of each police officer or parking enforcement officer of the Borough to report to the Police Chief by special parking tickets, numbered consecutively, the following information for each violation of §§ 231-5, 231-6, 231-7, 231-8, 231-9 and 231-10 of this chapter reported by him or her:
(1) 
The number or location of the parking kiosk which indicates that the vehicle was parked in violation of any of the provisions of this chapter.
(2) 
The date and hour of such violation.
(3) 
The state license number of such vehicle.
(4) 
Any other facts, a knowledge of which is necessary or desirable to a thorough understanding of the circumstances attending such violation.
B. 
Each police officer or parking enforcement officer shall place on each vehicle reported for violation of any of the provisions of §§ 231-5, 231-6, 231-7, 231-8, 231-9 and 231-10 of this chapter a notice to the owner or operator thereof that the vehicle has been parked in violation of the provisions of this chapter and instructing such owner or operator to pay, within 10 days, a penalty of not less than $2 and not more than $50 to the police headquarters of the Borough of Lansdowne. The exact amount of the fine may be determined by resolution of the Borough Council from time to time. Failure to pay within the prescribed time will result in an additional penalty of $10 for each violation.
It shall be unlawful for any person to deposit or cause to be deposited in a parking kiosk any payment for the purpose of increasing or extending the parking time of any vehicle beyond the total legal parking time of 10 hours.
Any person violating the provisions of this chapter shall, upon conviction thereof, be subject to a fine of not more than $600, plus costs of prosecution, and in default of payment of such fine and costs to imprisonment for not more than 30 days.
