No person under eighteen years of age shall be upon the public streets, alleys, parks, public buildings, places of amusement and entertainment, vacant lots, or other unsupervised places between the following hours of time: September 1st to June 1st; Sunday through Thursday, ten p.m. to five a.m. the following day. June 1st to September 1st; Sunday through Thursday, 11:01 p.m. to five a.m. Saturday and Sunday 12:01 a.m. to five a.m., throughout the year.

The following exceptions apply to the curfew:
A. 
The person is accompanied by and in the charge of his/her parent or other authorized competent adult person.
B. 
The person is upon an emergency errand directed by his/her parent, guardian, or other adult having the care and custody of the minor.
C. 
The chief of police and city manager together may exempt an application of this chapter for a specific date or event of general community interest.
D. 
The person is leaving or going to or from work by the most direct route home or place of residence as possible.

In any prosecution for violation of the curfew, the presence of any person under the age of eighteen years, unattended as herein required, upon the public streets or other places listed in this chapter is prima facie evidence of a violation of this chapter by such minor person and the parent, guardian or adult person having charge of the minor.

No parent or other person having control of children under the age of eighteen years shall allow such minor child to be in any of the places enumerated during the hours indicated in Section 9.74.010 unless such minor child is accompanied by his/her parent or other competent and adult person, or the minor child is upon an emergency errand directed by his/her parent, guardian, or other adult person having the care and custody of the minor.

Any violation of this chapter by a person under the age of eighteen years or by his or her parent, guardian, or other adult person having the care and custody of the minor child under eighteen years of age, or both, is punishable by a fine of seventy-five dollars and such person shall also pay any surcharge required to be imposed under AS 12.55.039.
