(a) 
The purpose of this chapter is to regulate portable spray-finishing operations using flammable or combustible liquids to ensure that the spray-finishing operations will not impact neighboring properties or public safety.
(b) 
This chapter applies to portable spray-finishing operations that are conducted in an "open-air" environment, including, but not limited to, automotive and equipment refinishing and touch-up operations.

Businesses conducting portable spray-finishing operations within the City limits of Santa Clara are required to obtain a business license prior to conducting business in the City of Santa Clara.

Generators of hazardous waste must obtain an Environmental Protection Agency Identification Number (EPA ID Number) from the California Department of Toxic Substances Control and be registered with the Santa Clara Fire Department as a hazardous waste generator prior to commencing operations. Prior to commencing operation, such generators must also prior to undertaking any activities obtain and maintain a current hazardous waste generator permit with the City of Santa Clara Fire Department.

(a) 
Portable spray-finishing operations shall not be conducted within one hundred fifty (150) feet of any property line, or within one hundred (100) feet of any building.
(b) 
Portable spray-finishing operations shall not be conducted within one hundred fifty (150) feet of any public property.
(c) 
Portable spray-finishing operations shall be conducted in areas and in a manner that does not create a hazard or nuisance.
(d) 
The total area being finished shall not exceed two square feet on any vehicle or piece of equipment. Per day, no more than three vehicles or pieces of equipment may be spray-finished at any given location or address.
(e) 
A sufficient means to collect, contain and remove all over-spray shall be provided and used in all spray-finishing operations.
(f) 
Spray-finishing operations shall not create odors outside of the spraying area.
(g) 
When spray-finishing operations are being conducted on private property, written approval for all facets of such operations shall be obtained from the property owner.
(h) 
Dispensing, use and storage of flammable and combustible liquids shall be conducted in compliance with the Santa Clara Municipal Fire and Environmental Code.
(i) 
Spray-finishing operations shall be conducted in compliance with the Bay Area Air Quality Management District's Regulation 8, Rule 45 or any other applicable regulation or standard.
(j) 
Portable spray-finishing operations shall only be conducted in an open-air environment and shall not be conducted under any canopy, in any tent or other structure.
(k) 
Portable equipment used in spray-finishing operations shall be listed and approved for such use.
(l) 
Businesses and/or persons conducting spray-finishing operations assume all responsibility for any damage, whether public or private, that is determined by the City to be a result of their spray-finishing operations.

(a) 
The area where portable spray-finishing operations are being conducted must be clearly identified by cones and signage in order to prevent nonauthorized persons from entering the area.
(b) 
There shall be signage posted around the areas in which portable spray-finishing operations are being conducted that state "No Smoking, Open Flames or Spark-Producing Equipment within 50 feet."
(c) 
Spill cleanup and control equipment supplies shall be present and maintained in the area during the time which spraying operations are being conducted.
(d) 
A 4A:80B:C fire extinguisher shall be available within fifty (50) feet, but not closer than twenty-five (25) feet, from the spray-finishing operations.

(a) 
Hazardous waste shall be managed in conformance with the California Health and Safety Code, Chapter 6.5, and the California Code of Regulations, Title 22. Waste paints, solvents, paint-related materials and residue from wet sanding shall be managed as hazardous waste unless the generator of the waste determines that the waste is nonhazardous using methods described in California Code of Regulations, Title 22, Section 66262.11.
(b) 
After the conclusion of spray-finishing operations each day, over-spray residue shall be removed and disposed of properly.
(c) 
Hazardous waste paint, solvent and paint-related hazardous waste shall be placed in containers labeled as "Hazardous Waste" in accordance with California Code of Regulations, Title 22, Sections 66262.34(e) and 66262.34(f).
(d) 
No chemicals, waste or wash water shall be discarded onto the ground or into the storm drain system.
(e) 
Before and during operations, measures must be taken to sufficiently safeguard the storm drain system in order to prevent materials from entering and contaminating the storm drain system.
