The board of supervisors of the county of Contra Costa, an agency of the state of California within the meaning of Government Code Section 50022.1, has adopted County Ordinances No. 80-97, 83-10, 85-23, 87-74, 2005-24, 2006-05, 2011-08, 2011-09, and 2017-12 regarding animal control. These ordinances are codified as Chapters 416-2 to 416-12.4 of Division 416 of the County Ordinance Code, which is a code within the meaning of Government Code Section 50022.2. Certified copies of Division 416 are and have been on file with the city clerk where they are open to public inspection as required by Government Code Section 50022.3. This Animal Control Code, Division 416, is referred to and adopted by this reference as a part of the Pittsburg Municipal Code under Government Code Section 50022.2.

Summary. This section amends Section 416-4.604 (this Contra Costa County Ordinance adopted by reference by the city of Pittsburg), "Penalties," to provide that violation of Section 416-4.404, "Abandonment," is a misdemeanor and punishable as such.
B. 
Section 416-4.604 is amended to read:
416-4.604 Penalties.
a. Notwithstanding Section 14-8.004, and pursuant to Food and Agriculture Code 31401, violations of Division 416 of this code, excepting Chapter 416-10 and Article 416-12.2, are punishable by a fine of not more than fifty dollars for the first offense, and not more than one hundred dollars for the second or subsequent offense.
b. Notwithstanding subsection (a) above, violation of section 416-4.404 Abandonment, excluding abandonments under section 416-8.014, is a misdemeanor and punishable as such.

The purpose of this chapter is to establish standards for the keeping of livestock, animals, fowl and bees in a manner which will not endanger the health, peace and safety of the citizens of the city and which will assure that the livestock, animals, fowl and bees are kept in a clean and sanitary condition and not subjected to suffering, cruelty or abuse.

In this chapter, unless the context otherwise requires:
"Animal"
means any domestic animal (such as, without limitation, a dog or cat), and includes livestock and fowl.
"Coop"
means a covered enclosure for the shelter of fowl.
"Fowl"
means a domesticated chicken, duck, goose, guinea fowl, peafowl, turkey dove, pigeon, game bird or similar bird intended for human consumption or for the production of eggs for human consumption.
"Livestock"
means any domestic animal such as a cow, donkey, mule, burro, horse, sheep, goat, pig, hare or rabbit, but excluding a pot belly pig or an animal kept by a public or private school for educational purposes.
"Stall"
means a covered enclosure or shelter, barn, stable or other outbuilding for the shelter of livestock.

No person may keep more than three dogs of six months in age nor more than five cats of six months in age or older for noncommercial purposes for more than 30 days without a multiple pet license, except where allowed under PMC Title 18.

No person may keep or allow to be kept on premises owned, occupied or controlled by him, livestock, fowl or bees within 50 feet of a dwelling unit or within 25 feet of any property line.

No person may keep an animal in such a way as to create a nuisance or disturb residents in the neighborhood by noise, odor or damage to nearby property or interfere with the enjoyment of property by its owners or residents.

Where more than one fowl or livestock animal is permitted under the municipal code, they must be kept under the following conditions:
A. 
The fowl and livestock shall be confined within a suitable coop or stall after sundown.
B. 
A stall shall include bedding for livestock such as wood shaving, shredded bark, straw or sawdust.
C. 
A coop shall have a concrete floor, reasonably impervious to moisture. The concrete floor shall be sloped so as to lead drainage to an outlet point and a drainage system shall be provided.
D. 
The stall or coop shall at all times be maintained in a clean and sanitary condition, shall be cleaned once a week or more often if necessary, and shall at all times be free from offensive odors and flies.
E. 
No part of a stall or coop may be less than 50 feet from a dwelling unit or less than 25 feet from any property line of the lot or parcel of land upon which it is situated.

The city health officer or his agent may inspect the premises where livestock, fowl or bees are kept for compliance with this chapter.
