Pursuant to the provisions of Sections 53730 to 53737 inclusive of the Government Code of the state, the city council is authorized and directed to establish a capital outlay fund for the purposes in the sections set forth and to levy and collect assessments and taxes for the creation and accumulation of such fund. The city council is also authorized and empowered to transfer to such fund from time to time any unencumbered surplus funds remaining on hand at the end of any fiscal year or such portion or amount thereof as the council may deem advisable.

To comply with the provisions of Article 5 of Chapter 1 of Division 1 of the Streets and Highways Code, with particular reference to the amendments made thereto by Chapter 642, Statutes of 1935, there is created in the city treasury a special fund to be known as the "Special Gas Tax Street Improvement Fund."
