The Town Manager, acting by virtue of the authority granted by Chapter II, Article VIII, Section 2 of the General Ordinances, Chapter 40, Section 22, of the General Laws and by virtue of any other power it hereto enabling, hereby adopts and makes the following rules and orders for the regulation of carriages and vehicles used in the Town of Barnstable and for regulating traffic upon the public streets, ways, highways, parking areas, beaches and other Town owned land of said Town; insofar as the said rules and orders or any of them are the same as the regulations, rules and orders now in force they shall be deemed to be a continuation thereof.
A. 
For the purpose of these rules and regulations, the words and phrases used herein shall have the following meanings except in those instances where the context clearly indicates a different meaning.
B. 
Whenever any words and phrases used herein are not defined herein but are defined in the state laws regulating the operation of vehicles, any such definition therein shall be deemed to apply to such words and phrases used herein.
ALLEY
An unnamed private narrow roadway or passageway serving as a secondary means of access to two or more pieces of property, but not as a primary means of access to any property.
BICYCLE
A vehicle, usually designed for one person, consisting of a metal frame mounted upon two wire spoke wheels with narrow rubber tires in tandem, two pedals and propelled by muscular power. Wherever used herein, the word "bicycle" shall also be interpreted as including a tricycle which is usually designed for one person with a metal frame mounted upon three wire spoke wheels with narrow rubber tires and propelled by muscular power.
BIKE PATH
A paved pathway usually separated from the roadway reserved for the exclusive use of persons riding bicycles and pedestrians.
BUS STOP
An area in the roadway adjacent to the curb or edge of the roadway set aside for the boarding of or alighting from buses.
BUSINESS DISTRICT
An area officially designated using the terms "business" or "industrial" in the title of the district in the Town of Barnstable Zoning Ordinance.
CONGESTED AREA
An area that is either thickly settled or a business district and/or frequented by sizeable number of pedestrians and/or vehicles.
CROSSWALK
That portion of a roadway ordinarily included within the curb lines and property lines at intersections, or at any portion of a roadway clearly indicated for pedestrian crossing by lines on the road surface of by other marking or signs.
CURB MARKING
That portion of a curbing, the painting of which has been authorized by the Town Manager and which serves as a supplementary warning of a parking restriction.
EMERGENCY VEHICLE
Vehicles of the Fire Department, police vehicles, ambulances and emergency vehicles of federal, state and municipal departments or public service corporations when the latter are responding to an emergency in relation to the Police or Fire Department.
FUNERAL
Any procession of mourners properly identified as such accompanying the remains of a human body.
INTERSECTION
(1) 
The area embraced within the extensions of the lateral curb lines, or if none, then the lateral boundary lines, of intersecting ways as defined in Section 1 of Chapter 90 of the General Laws, including divided ways.
(2) 
The rules and regulations herein contained governing and restricting the movement of vehicles at and near intersecting ways shall apply at any place along any way at which drivers are to be controlled by traffic control signals whether or not such place is an intersection as herein defined.
LANE
A longitudinal division of a roadway into a strip of sufficient width to accommodate the passage of a single line of vehicles.
OFFICER
Any officer of the Barnstable Police Department or any officer authorized to direct or regulate traffic or to make arrests for the violation of traffic regulations.
PARKING
The standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading, or in obedience to an officer or traffic signs or signals, or while making emergency repairs or, if disabled, while arrangements are being made to move such vehicle.
PARKING METER
Any electric, electromechanical, or mechanical device, not inconsistent with the provisions of these rules and regulations and placed or erected on any public way or municipal off-street parking area within the Town of Barnstable for the regulation of parking. Each parking meter installed shall indicate by proper legend the legal parking time established by this regulation and when operated shall at all times indicate the balance of legal parking time permitted and at the expiration of such period shall indicate illegal or overtime parking.
PARKING METER SPACE
Any space within a parking meter zone, adjacent to a parking meter which is duly designated for the parking of a single vehicle by lines painted on the surface of the street or municipal off-street parking area adjacent to or adjoining each parking meter.
PARKING METER ZONE
The words "parking meter zone" shall mean and include any street or portion thereof or municipal off-street parking area upon which parking of vehicles is permitted for a limited time subject to compliance with the further provisions of this regulation.
PEDESTRIAN
Any person a foot or riding on a conveyance moved by human muscular power, except bicycles or tricycles, as defined in Chapter 90, Section 18A (General Laws).
PERSON
Any natural person, firm, co-partnership, association or corporation.
RAILROAD CROSSING
Any intersection of ways with a railroad right-of-way.
ROADWAY
That portion of a street or highway between the regularly established curb lines or that part, exclusive of shoulders, improved and intended to be used for vehicular traffic.
ROTARY TRAFFIC
The counter clockwise operation of a vehicle around an object, structure or island in the roadway.
SAFETY ZONE
Any area or space set aside within a roadway for the exclusive use of pedestrian(s) and which has been indicated by signs, lines or marking, having the written approval of the Town Manager.
SCHOOL ZONE
A school zone shall be construed to be that section of a way which begins not more than 300 feet in advance of the grounds of a school in a non-speed zone; not less than 850 feet in advance of the grounds of a school in a speed zone in rural areas; and 500 feet, or one block, which ever is smaller, in advance of the school grounds in urban areas and is marked in accordance with standards established by the Massachusetts Highway Department to indicate the applicability of the statutory speed limits of 20 miles per hour for all vehicles in accordance with the terms of the permit for the zone.
SERVICE ZONE
An area in the roadway set aside for the accommodation of commercial and transient vehicular traffic.
SIDEWALKS
A paved or unpaved footway separated from the roadway reserved for the exclusive use of pedestrians on which to walk.
SPEED ZONE
A roadway or portion thereof for which a special speed regulation has been formally adopted by the Town. Special speed regulations require the approval of a town conducted study and certification of the regulation by the Massachusetts Highway Department acting jointly with the Massachusetts Registry of Motor Vehicles.
STAND or STANDING
The stopping of a vehicle, whether occupied or not, otherwise than for the purpose of, and while actually engaged in, receiving or discharging of passengers.
STOP
When required means complete cessation of movement.
STREET MARKING, OFFICIAL
Any painted line, legend, marking or marker of any description painted or placed upon any way which purports to direct or regulate traffic and which has been authorized by the Town Manager.
STREET or HIGHWAY
The entire layout width between property lines of every way open to the use of the public.
TAXICAB STANDS
An area in the roadway in which certain taxicabs are authorized and required by the Town Manager to park while waiting to be engaged.
TRAFFIC
Pedestrians, other conveyances street or highway ridden or herded animals, vehicles, or either singly or together while using any for the purpose of travel.
TRAFFIC CONTROL AREA
Any area along any way, other than an intersecting way, at which drivers are to be controlled by traffic control signals.
TRAFFIC CONTROL DEVICES, OFFICIAL
All signs, signals, markings and devices not inconsistent with these rules and regulations, and which conform to the standards prescribed by the Massachusetts Highway Department, and which placed or erected by authority of the Town Manager for the purpose of guiding, directing, warning, or regulating traffic.
TRAFFIC CONTROL SIGNAL
Any device using colored lights which conforms to the standards as prescribed by the Massachusetts Highway Department, whether manually, electrically or mechanically operated, by which traffic may be alternately directed to stop and to proceed.
TRAFFIC ISLAND
Any area or space set aside within a roadway which is not intended for use by vehicular traffic.
TRAFFIC SIGNALS, OFFICIAL
All signals, conforming to the standards as prescribed by the Massachusetts Highway Department, not inconsistent with these rules and orders, placed or erected by authority of the Town Manager.
TRAFFIC SIGNS, OFFICIAL
All signs, markings and devices, other than signals, not inconsistent with these rules and orders, and which conform to the standards prescribed by the Massachusetts Highway Department and placed or erected by authority of the Town Manager.
TRICYCLE
Included within the definition of the word "bicycle" for the purposes of this ordinance.
U-TURN
The turning of a vehicle by means of a continuous turn whereby the direction of such vehicle is reversed.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including bicycles when the provisions of these rules are specifically applicable to them, except other devices moved by human power or used exclusively upon stationary rails or tracks and devices which derive their power for operation from stationary overhead wires.
VEHICLE, COMMERCIAL
Any vehicle being used in the transportation of persons, goods, wares or merchandise for profit purposes.
VEHICLE, HEAVY COMMERCIAL
Any commercial vehicle of over 2 1/2 ton capacity.
