To ensure the preservation and maintenance of the Marysville cemetery district there is established the cemetery commission of the city of Marysville.

The cemetery commission shall be composed of seven members, including two at-large members. Each city councilmember shall appoint one cemetery commission member subject to the concurrence of a majority of the city council. The mayor shall also appoint the two at-large cemetery commissioners subject to the concurrence of a majority of the city council.

Cemetery commission members shall serve while their appointing city councilmember serves on the council, excepting at-large commission members who shall serve the full term of office. If a commission vacancy occurs, other than by expiration of term, the appointing city councilmember, or mayor in the case of at-large commission members, shall appoint a commission member, subject to the concurrence of a majority of the city council, for the appointing councilmember's remaining time in office, or for the remaining at-large term of office. Except for at-large commission members, if a councilmember serves less than his or her term, the term of the commission member appointed by that councilmember shall expire on the last day the appointing councilmember holds office. The councilmember elected or appointed to fill the vacancy shall appoint a commission member in accordance with provisions of Section 2.70.020. One at-large member shall be appointed for a six-year term of office and one at-large member shall be appointed for a term of three years. Thereafter, at-large cemetery commission members shall be appointed for a six-year term of office.

Cemetery commission members serve at the pleasure of the city council. Any member of the commission may at any time be removed from office, without cause, by the appointing council member or mayor, as appropriate. Any member of the commission shall be removed from office if the member fails to attend, excluding excused absences, a minimum of one commission meeting during a six-month period of time. The removal from office shall be mandatory unless disapproved by the city council. Any member of the commission unable to attend a meeting shall give notice to the public works director at least one business day prior to the date of the meeting.

The cemetery commission shall have and exercise all the powers and duties as may be granted or imposed by ordinances of the city and the rules and regulations pursuant to Section 2.70.060.

The commission shall meet at least once every three months, keep a record of its resolutions, findings and determinations, and adopt rules and regulations pertaining to its meetings and the transaction of its business. The commission's rules and regulations, or any amendments thereto, shall not become effective until approved by a majority of the city council. Special meetings may be called at any time by the chairman or by two members of the commission. Four members shall constitute a quorum for the transaction of business except as otherwise provided in state law or ordinance of the city. No action shall be taken without receiving the affirmative vote of a majority of the members of the commission.

The cemetery commission shall elect its chairman and vice-chairman from among the appointed members for a term of one year at the first regular meeting in January of each year. The chairman's and vice-chairman's titles and powers may, at any time, be reassigned by a majority vote of the commission.

The city council shall provide the funds, equipment and accommodations necessary for the work of the cemetery commission.

The functions of the commission are as follows:
(1) 
It shall develop and maintain a comprehensive plan for the maintenance and protection of the cemetery.
(2) 
It shall investigate and make recommendations to the city council upon reasonable and practical means for putting the plan into effect and as the basis for the efficient expenditure of funds relating to the cemetery.
(3) 
It shall periodically review the improvement program for the cemetery.
(4) 
It shall perform such other functions as the city council may provide.

Appeal from any finding of the cemetery commission may be made in writing to the city council, acting in its capacity as the cemetery district board of directors, within ten days from the date of the commission's action. The appeal shall be accompanied by a fee in an amount established by resolution, no part of which shall be returnable to the appellant.

Each member of the cemetery commission shall receive the sum of fifteen dollars for each cemetery commission meeting attended.
