The provisions of this chapter concerning the licensing and regulation of bicycles are enacted pursuant to grants of authority to cities under the constitution of the state, and the provisions of Division 16.7 of the Vehicle Code. The procedures and regulations set forth in the Vehicle Code shall govern whenever this chapter does not set forth any specific procedure or regulation.

It is unlawful for any resident to operate or use a bicycle, as defined in Section 39000 of the Vehicle Code, upon any street, public path or way, or other public property within the city unless such bicycle is licensed in accordance with the provisions of this chapter. Such operation or use shall also be subject to all other applicable regulations set forth in this title.

A. 
General Procedure. Applications for bicycle licenses shall be made to the chief of police upon forms provided by the city, which forms shall be signed by the applicant and shall contain the name, date of birth, address and telephone number, if any, of the applicant, and a complete description of the make, type and model of the bicycle, including any frame or serial number. Upon proper application, appropriate proof of ownership, and the payment of a license fee in the amount specified by resolution of the city council, the chief of police or a duly authorized agent shall issue a written receipt, a registration card, and a Department of Motor Vehicles' authorized license tag, plate or seal, which shall be attached to the bicycle.
B. 
Authorized Agent. The chief of police may designate as a duly authorized agent, for the purpose of issuing bicycle licenses, any person who holds a valid business license issued pursuant to the provisions of Chapter 2.08 of Title 2 of this code to engage in the business of buying or selling bicycles or bicycle frames within the city. The chief of police is authorized to issue rules and regulations to implement the provisions of this subsection.
C. 
Fees.
1. 
A license fee in an amount established by resolution of the city council shall be paid to the chief of police or to a duly authorized agent by all persons under the age of sixty-five.
2. 
A fee in an amount established by resolution of the city council shall be paid for the purpose of transferring the ownership of any bicycle having a current state-authorized license attached.
3. 
The city may waive any license fee or transfer fee for any bicycle owned by a person sixty-five years of age or older.
4. 
Bicycle dealers having valid business licenses issued pursuant to the provisions of Chapter 2.08 of Title 2 of this code shall be exempt from the payment of all fees when acquiring bicycles for sale, resale or trade.
5. 
The licensing period shall initially be the period commencing on the effective date of the ordinance codified in this chapter and ending on December 31, 1994. Thereafter, the licensing period shall be every three years, or such other period as may be established by the chief of police in accordance with Section 39001 of the Vehicle Code.
D. 
Use of Revenue. All revenues derived from license fees shall be used in a manner consistent with Section 39004 of the Vehicle Code.

A. 
License plates, tags or seals shall be of a type and in a number series authorized by the Department of Motor Vehicles and issued to the city. Each indicia shall bear a unique license number and shall be permanently assigned to a bicycle. Such indicia shall be sealed or otherwise affixed to the frame of the bicycle in such a manner that it cannot be removed without breaking the seal or connecting device.
B. 
The chief of police shall keep a record of the name and address of the person to whom each license is issued, the number of the license, the make, type, model and serial number of the bicycle, and such other information as may be necessary to identify the bicycle and the owner thereof.

A. 
Every person engaged in the business of buying, selling, exchanging, or trading in new, used, or secondhand bicycles shall make a report within a ten-day period to the chief of police of all new bicycles sold, together with a complete description thereof, the person to whom sold, his address, age, height and weight, and of any secondhand bicycles or bicycle parts bought, exchanged or traded in, together with a complete description thereof, and the name, address, age, height, and weight of the person from whom purchased or obtained. It is unlawful for anyone engaged in such business to purchase a secondhand bicycle or any bicycle part from a minor under eighteen years of age.
B. 
Each bicycle retailer shall supply to each purchaser a record of the following information: the name of the retailer, the address of the retailer, the year and make of the bicycle, and the serial number of the bicycle.

Every person engaged in the business of renting bicycles shall obtain a license for each bicycle to be used for rental purposes and shall keep a record, open to the inspection of the chief of police, of the name, address, telephone number and general description of each person renting a bicycle and the bicycle rented by such person.

A. 
It is unlawful for any person to sell or otherwise transfer the ownership of any bicycle without reporting such transfer within ten days thereafter to the chief of police or to an authorized agent and returning to the chief of police the registration card issued to such person, together with information concerning the name, address and description of the person to whom such bicycle was sold or transferred.
B. 
It shall be the duty of any such purchaser or transferee to apply for a transfer of registration, if a current valid license is on the bicycle, or to reregister such bicycle as required by this chapter within ten days after such sale or transfer.
C. 
Whenever the owner of a bicycle licensed pursuant to the provisions of this chapter changes his address, he shall, within ten days, notify the chief of police or an authorized agent of the old and new address. There shall be no fee charged for such notice.

It is unlawful for any person wilfully or maliciously, or without the authority of the owner, to remove, destroy, mutilate, alter, ride, or tamper with any bicycle, or any part thereof, or any license plate, seal or registration card issued in connection therewith.

Every license issued pursuant to the provisions of this chapter shall be subject to the following conditions:
A. 
The licensee shall comply with all laws of the city and the state applicable to the operation of a bicycle.
B. 
The bicycle shall be kept in good working order at all times.
C. 
The operator of a bicycle shall operate such bicycle with due regard to the surface, width and type of public street, highway or public path upon which the bicycle is being operated, the pedestrians and other vehicles thereon, and the traffic regulations applicable thereto.
