The developer or subdivider may upon written application to the planning and zoning commission request a variance from certain regulations of this chapter. Where the planning and zoning commission finds that hardship may result from strict compliance with these regulations, the commission may recommend to the town council to vary the regulations; provided, that such variations will not have the effect of nullifying the intent and purpose of the general development plan or these regulations.
