Except as otherwise provided in the Prosser Municipal Code, all fees charged by the Prosser police department shall be set by a separate ordinance passed by the city council.

A. 
Except as provided in subsections B and C of this section, all firearms that have come into the possession of the Prosser police department since June 30, 1993, that are judiciously forfeited under RCW 9.41.098, and no longer needed for evidence, or forfeited due to a failure to make a claim under RCW 63.32.010, or RCW 63.40.010, may be disposed of by the Prosser police department in its discretion as follows:
1. 
Retained for agency use;
2. 
Traded to commercial sellers;
3. 
Auctioned to commercial sellers; or
4. 
Destroyed.
B. 
All firearms that are "antiques" as defined by RCW 9.41.150, or recognized as curios, relics and firearms of particular historical significance by the Bureau of Alcohol, Tobacco and Firearms (or any successor agency) shall be disposed of by auction or traded to commercial sellers.
C. 
All firearms that are illegal to possess, as defined in subsection D of this section, shall be destroyed, and shall not be retained, traded or auctioned. If firearms otherwise illegal to possess may be rendered legal to possess by removal or alteration of component parts, the Prosser police department may, in its discretion, effect such removal or alteration, and may thereafter dispose of the firearm under subsection A of this section.
D. 
"Firearms that are illegal to possess" means firearms that are illegal to possess as a private citizen under state or federal law.
E. 
Any proceeds from the trade or auction of firearms shall be used by the Prosser police department.

A. 
Definitions. For the purposes of this section, the following definitions apply:
1. 
"Reserve Officer"
means any volunteer, non-employee, fully commissioned police officer who provides services to support and augment the Prosser Police Department. Reserve Officers serve on a voluntary basis and are not considered employees of the City, except as otherwise provided by law.
2. 
"Service Points"
means the standardized unit of measurement assigned to approved Reserve Officer activities as established by department policy and adopted by the City Council.
3. 
"Approved Activities"
means those activities authorized by the Police Department for which Service Points may be earned, including but not limited to patrol assistance, training, meetings, community events, special assignments, recruitment activities, and emergency call-outs.
B. 
Service Point Compensation Program.
1. 
The City establishes a Service Point Compensation Program to provide nominal stipend-based compensation to Reserve Officers for participation in Approved Activities.
2. 
Service Points shall be assigned in accordance with a schedule approved by the Police Department and consistent with applicable state law.
3. 
Service Points accumulated by a Reserve Officer shall be converted to compensation based on a per-point dollar value established annually by the City Council through the budget process.
4. 
Compensation provided under this section is intended to be nominal, stipend-based compensation for volunteer services and shall not be construed as wages or salary, nor shall it create an employer-employee relationship.
C. 
Point Accrual and Participation.
1. 
Reserve Officers shall be responsible for documenting participation in Approved Activities, including:
a. 
Date of activity.
b. 
Type of activity.
c. 
Duration of service.
d. 
Supervising officer verification.
2. 
The Police Chief or designee shall establish procedures for tracking, reviewing, and approving Service Points.
3. 
The department may establish minimum participation expectations and eligibility requirements consistent with program policy.
D. 
Compensation and Payment.
1. 
Approved Service Points shall be totaled on a monthly basis.
2. 
Compensation shall be issued monthly based on the total approved Service Points and the established per-point value.
3. 
The City may establish a maximum annual compensation limit for Reserve Officers through the annual budget process.
E. 
Administration. The Police Chief or designee shall administer this program and is authorized to:
1. 
Approve eligible activities.
2. 
Establish scheduling and participation procedures.
3. 
Review and approve Service Point submissions.
4. 
Ensure compliance with applicable state laws and training standards.

The police chief may issue a limited commission to persons outside the police department who have a need to have limited enforcement capabilities such as, but not limited to, animal control, code enforcement, parking, and parks. These limited commissions will specifically state the ordinances for which the holder may issue citations for civil infractions. The police chief shall develop standards for the selection and training of those being granted a limited commission. The limited commission may be revoked at any time by the police chief.

If any section, subsection, sentence, clause, paragraph, phrase, or word of this chapter should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause, paragraph, phrase or word of this chapter.
