If at any time subsequent to the first repair of a surface of a highway damaged or destroyed by any excavation, encroachment or moving operation in such highway it becomes necessary again to repair such surface due to settlement or any other cause directly attributable to such excavation, encroachment or moving operation, the permittee shall pay to the Director the cost of such additional repair; provided, however, that the Director shall have the option of either making the repair or requiring the permittee to make the repair.

The Director may elect not to issue further permits to the permittee and may hold any deposits, guarantees, or bonds of the permittee as long as any bill remains unpaid.
