This Municipality agrees that Manheim Township and East Lampeter Township shall join with each other in accordance with the Pennsylvania Intergovernmental Cooperation Act[1] by entering into the Intermunicipal Agreement which is adopted by reference with the same effect as if it had been set out verbatim in this section and a copy of which shall be filed with the minutes of the meeting at which this article was enacted.

This Municipality is authorized to enter into the Intermunicipal Agreement for the purposes contained therein. This action is to be taken by the officials or employees of the Municipality designated for this purpose, pursuant to general or specific instructions issued by the governing body.
As required by the Intergovernmental Cooperation Act, the following matters are specifically found and determined:
A. 
The conditions of the agreement are set forth in the Intermunicipal Agreement referred to in § 30-20.
B. 
The Intermunicipal Agreement shall commence upon the effective date of this article and will continue until terminated by either Municipality.
C. 
The purposes and objectives of the Intermunicipal Agreement are to provide East Lampeter Township residents with a drop-off location to dispose of yard waste consisting of garden residue, shrubbery and tree prunings, sod, grass and leaves.
D. 
East Lampeter Compost Park access cards will be purchased, as needed, by Manheim Township and costs will be reimbursed by East Lampeter Township.
E. 
No new organizational structure is proposed by the Intermunicipal Agreement.
F. 
The Intermunicipal Agreement does not contemplate the purchase of any real or personal property.
G. 
Each Municipality has the power to enter into contracts for the policies of insurance or other employee benefits. It is not anticipated that any additional employees will be employed to carry out the purposes of the Intermunicipal Agreement.
In the event any provision, section, sentence, clause, or part of this article shall be held to be invalid, illegal, or unconstitutional by a court of competent jurisdiction, such invalidity, illegality, or unconstitutionality shall not affect or impair the remaining provisions, sections, sentences, clauses, or parts of this article, it being the intent of the Board of Supervisors that the remainder of the article shall be and shall remain in full force and effect.
