The structure of town government shall be the council-manager form of government. The council shall be responsible for the legislative functions of the municipality, such as establishing policies, adopting local ordinances, voting appropriations, developing an overall vision for the community, and other such functions as provided by law, and council members shall provide advice to the town manager regarding implementation of the policies of the council. The town manager shall be the chief administrative officer of the town and shall work under the general direction of the council to ensure effective, efficient and equitable delivery of government services.

The elected officers of the town shall be seven council members who shall serve four-year staggered terms, one of whom shall be designated as mayor, and one of whom shall be designated as vice mayor, in accordance with STC § 2.10.010. The council members shall constitute the town council, also known as the council, and shall continue in office until assumption of duties of office by their duly elected successors.

Each candidate for the office of council member shall file a financial disclosure statement on a form prescribed by the town clerk when such candidate files a nomination paper. The statement shall contain such information as required by state law or resolution of the council.

The council shall meet and canvass the primary election not less than six days nor more than 20 days following the election pursuant to ARS 16-642. Pursuant to ARS 9-821.01, any candidate for the council who receives a majority of all votes cast at the primary election shall be declared elected, effective as of the date of the general election, and no further election shall be held as to such candidate. Such candidate shall be administered the oath of office as provided in STC § 2.05.080. For the purposes of this subsection, the majority of votes cast is determined as provided in ARS 9-821.01(D).

If, at the primary election, no candidate receives the majority of the votes cast, or the number of seats to be filled is greater than the number of candidates who receive a majority of votes cast, the candidates who will proceed to the general election shall be determined as provided in ARS 9-821.01(F).

The mayor shall declare a vacancy on the council as defined in ARS 9-232(D) and 38-291, and the council shall fill such vacancy as provided in ARS 9-235.

The compensation of elected officers of the town shall be fixed from time to time by resolution of the council. Any modification of the compensation shall not become effective until after the canvass of the next election of council members.

There is reserved to the qualified electors of the town the power of the initiative and the referendum as prescribed by the state constitution and ARS 19-101 et seq. Pursuant to ARS 19-143, for initiative measures, the total number of qualified electors of the town shall be the basis for computing the number of qualified electors of the town required to sign the petition.
