This chapter is adopted to help preserve parking opportunities within certain defined residential areas of the city which, due to the high demand for parking created by various recreational activities, have extremely limited on-street parking available, and to encourage visitors to utilize the city's available recreational parking areas.

When properly issued and displayed, a residential parking permit, "permit," shall exempt a vehicle, while properly parked on a street or alley within a specific limited parking zone for which the permit was issued, from citation for parking in that particular zone and no other. The permit shall not guarantee a parking space, nor shall it exempt the vehicle or operator from observing all other applicable laws including but not limited to no parking zones, load zones, and fire lane no parking zones.

The following requirements are established for the revision of the residential parking zone (RPZ) boundaries as defined by WRMC 10.14.500:
A. 
Requests must be made in writing to the city of West Richland's public works director;
B. 
Revisions to the RPZ boundaries may be in a minimum of one-block segments (one side of roadway). In situations where the block lengths exceeds 500 lineal feet, a revision of a minimum of 300 lineal feet in length will be allowed;
C. 
The RPZ boundaries shall remain contiguous and no revision shall create pockets of non-RPZ parking areas within the outer boundaries of the overall RPZ zones;
D. 
The written request(s), as described in subsection A of this section, shall have the support of at least 60 percent of the immediate adjacent property owner(s), based upon frontage foot of the subject proposed modification. Written support shall be in the form of either a letter or petition that shall include the signatures of the potentially affected property owners; and
E. 
Council adoption of an ordinance modifying the RPZ boundaries.

The city council may establish a residential parking zone which may have one or more of the following provisions:
A. 
Parking in the street or alley is reserved for the exclusive use by the owners of abutting properties; vehicles used by their visitors; and service vehicles having business with the residents; and/or
B. 
Residential parking zones shall be appropriately signed or marked; and/or
C. 
The mayor may temporarily suspend the parking limitations imposed by this chapter for public events.

A. 
Eligibility. Permits may be issued only to person(s) in a single-family residential unit or duplex unit residing within and abutting the residential parking zone area. In the case of residential rental property, one additional permit may also be issued to the actual property owner of the single-family residential or duplex property. Permits shall not be issued to person(s) residing within a multifamily apartment complex and/or mobile home/trailer park as these developments are required to provide their own off-street parking.
B. 
Proof of Residence. Proof of residence shall be established by:
1. 
Display of a valid driver's license reflecting a current address within the residential parking zone for which a permit is issued; or
2. 
Display of a deed, lease, rental agreement, utility account or other acceptable document(s) showing residency.

A. 
Authorization of Public Works Department. The West Richland public works department is authorized to issue permits to qualified residents and property owner.
B. 
Application Form. Application for permits shall be made on forms which shall include:
1. 
The name, address, telephone number and driver license number of applicant;
2. 
The make, model, color and year of the vehicle for which the permit is sought;
3. 
The type of document used to establish eligibility for the permit as required by WRMC 10.14.050;
4. 
The license plate number and state of vehicle;
5. 
A statement immediately above where the applicant is to sign stating that the applicant has been provided with an opportunity to examine this chapter and is familiar with the terms thereof. All applications shall be signed by the applicant.
C. 
No more than two permits shall be issued to any one residential dwelling unit; however, the public works department may issue additional permits if sufficient parking is determined to be available to accommodate the additional vehicle(s).

A. 
Display. Permits shall be displayed in the top center of the vehicle's front window.
B. 
Validity. Permits shall be valid only in the zone designated, valid only when parked abutting the property the person resides in and valid only for so long as the permit holder retains the vehicle and resides at the address specified in his or her application. Permits are nontransferable except to visitors of the residents abutting the residential parking zone area. Permits shall be valid for the year issued, January 1st through December 31st.
C. 
Expiration. Permits shall expire on December 31st of each calendar year.

Service vehicles parked in residential parking zones shall be exempt from holding a residential parking permit while making service calls to residential dwellings within the zone.

It shall be unlawful to do any of the following:
A. 
To make any false or misleading statement in application for permit.
B. 
To transfer a permit to another person; provided, permits may be temporarily lent or borrowed for a visitor.
C. 
To fraudulently alter a permit in any manner whatsoever.
D. 
To improperly display the permit or to violate any terms or conditions under which the permit was issued.
E. 
To use or permit to be used a revoked or suspended permit.
F. 
To copy, produce or otherwise bring into existence a facsimile or counterfeit permit or permits or to knowingly use or display a facsimile or counterfeit permit in order to evade parking limitations within a residential parking zone.

Permits may be revoked by the director of public works department for any of the following reasons:
A. 
The permit holder has made any false, misleading or incomplete statement in the application.
B. 
Violation of any of the provisions of this chapter.

If the director of public works department finds a permit should be revoked for any of the reasons set forth in WRMC 10.14.120, he or she shall cause a written notice to be sent to the permit holder at the address contained on the application. The notice shall contain the following information:
A. 
Advise the permit holder that the permit will be revoked on a specified date which shall not be fewer than 10 nor more than 13 calendar days from the date of the letter.
B. 
Advise the permit holder that unless a written notice of appeal, setting forth the reasons for the appeal, is filed with the public works department not later than the date set forth in subsection A of this section, the permit will be deemed revoked.
C. 
Advise the permit holder that if a written notice of appeal is filed within the required time, the date, time and place of the hearing will be set.
D. 
The reason for the revocation.

Upon receipt of the appeal, the mayor or the mayor's designee shall set a date for a hearing within 30 calendar days of the receipt of the notice of appeal and notify the appellant of the date, time and place of the hearing. The mayor or the mayor's designee shall render the decision within 10 calendar days after the hearing is closed, reduce the decision to writing and include a statement of the reasons for the decision. The mayor or the mayor's designee may affirm or reverse the revocation decision or order suspension for a specified period.

The penalty for parking in violation of this chapter shall be a $50.00 fine; provided, warning citations shall be issued for such violations during the first 30 calendar days after the creation of a residential parking zone. Any person violating any other provision of this chapter shall be guilty of a misdemeanor and upon conviction may be punished by a fine not to exceed $1,000.

It is unlawful, when signs are erected giving notice thereof, for any person to park a vehicle at any time upon any of the following streets or parts of streets within the following designated residential parking zones:
A. 
Zone 1 – Butte Court from S. 38th Ave. east a distance of 300 feet to the east end of the Butte Court.
