It is unlawful for any person under 18 years of age to purchase, attempt to purchase, to use or to possess tobacco products in the city of Leavenworth, Washington.

Any person who violates this chapter shall be guilty of a civil infraction and notice of a civil infraction shall be given in accordance with RCW 7.80.050. All such civil infractions shall be heard and determined by the city municipal court. Any person found to have committed a civil infraction in violation of this chapter shall be assessed a monetary penalty of $25.00 for the first infraction, the sum of $100.00 for any such infraction thereafter; provided, however, that the Leavenworth municipal court may waive the monetary penalty for the first infraction if the person who has violated the chapter enrolls in and completes a cessation program approved by the city of Leavenworth.

The city of Leavenworth municipal court may also order a person found to have committed a civil infraction under this chapter to make restitution.

The provisions of this chapter shall not apply if the person under the age of 18, with parental authorization, is participating in a controlled purchase as part of a Liquor Control Board, law enforcement or local health department activity, pursuant to RCW 70.155.080.
