(1) 
“Board of Directors”
means the Board of Directors of the Tulalip Tribes.
(2) 
“Fireworks”
means any composition or device containing any combustible or explosive substance for the purpose of producing a visible or audible effect by combustion, explosion, deflagration or detonation, excluding all firearms, which meets the definition of Consumer 1.4G fireworks (formally known as “Class C” fireworks) as set forth in the U.S. Department of Transportation’s (DOT) Hazardous Materials Regulation, Title 49, Code of Regulations (CFR), Parts 171 through 191 as may be hereafter amended.
(3) 
“Enforcement authorities”
means the Tax and Licensing Division of the Tulalip Tribes, Tulalip law enforcement, and any other person to whom the authority to administer and enforce this code shall have been delegated by the Board of Directors of the Tulalip Tribes.
(4) 
“Fireworks stand”
means a temporary structure or location at which fireworks are offered for retail sale.
(5) 
“License”
means authorization issued by the Tulalip Tribes under this code, through the Tax and Licensing Division, to engage in the transport, possession, discharge, or retail and/or wholesale sale of authorized fireworks on the Tulalip Reservation at such times and locations authorized by Board resolution. A license is personal to the licensee and is not transferable.
(6) 
“Retail licensee”
means a Tulalip Tribal member to whom a license has been issued under this code.
(7) 
“Regulations”
means, except as otherwise clearly indicated, any regulations duly promulgated by the Tax and Licensing Division pursuant to its authorities under this code.
(8) 
“Restraint”
means summary, pre-hearing closure of any retail fireworks stand, suspension or seizure of any license, seizure of any property, or removal of any person authorized in this code.
(9) 
“Sanction”
means any penalty whatsoever imposed by the Tribal Court or by the Tax and Licensing Division, for violation of any provision of this code, any regulations adopted hereunder, or any license issued pursuant to this code. The term includes but is not limited to any restraint, civil penalty, license suspension, modification or revocation, seizure, or any other form of penalty authorized in this code. Unless otherwise clearly indicated, all sanctions authorized under this code are cumulative and additional to any other sanction authorized in this code.
(10) 
“Tax and Licensing Division”
means the Tax and Licensing Division of the Tulalip Tribes or its designee.
(11) 
“Tribal Court”
means the Tribal Court of the Tulalip Tribes.
(12) 
“Tribal safe and sane fireworks”
means fireworks devices authorized by Article V of this chapter and not declared unlawful thereby.
(13) 
“Wholesale licensee”
means a person or company to whom a wholesale license has been issued under this code.
(14) 
“Retail sale”
means sale of fireworks authorized under this code to consumers by a licensed retailer.
(15) 
“Wholesale sales”
means sales of fireworks authorized under this code by a licensed wholesaler to a licensed retailer.
