The City of Binghamton possesses sewer flow credits that have been allocated to the City by the Binghamton-Johnson City Joint Sewage Treatment Plant. Sewer credits represent the allocation of capacity within different portions of the system and the overall system for future development or expansion. This Chapter 339A establishes the authority for the City to sell such sewer credits.
The City Engineer is hereby authorized to accept requests for, and approve the sale of, sewer credits to third-party users in the amount set forth in Schedule J, Fees, provided the Engineer may charge a lesser, reasonable fee based upon the expected impact of a proposed project on the City's sewer infrastructure or City involvement in the project. In assessing the impact of a proposed project the Engineer may consider:
A. 
The size nature of the development;
B. 
The size nature of any infiltration remediation at the project site;
C. 
The total number of available sewer credits available for the project;
D. 
The current demand for sewer credits; and
E. 
The anticipated City costs of construction, maintenance, and administrative expenses relating to the impact of the proposed project on the City's Sewer infrastructure.
All sales of sewer credits shall be made in accordance with all applicable regulations of the Binghamton-Johnson City Joint Sewage Treatment Plant and the intermunicipal agreement governing its operations.
