As used in this chapter, the term “fireworks” means all “consumer fireworks” as defined in RCW 70.77.136.

It is unlawful for any person to sell, use, transfer, discharge, ignite, or explode any fireworks within the city of Ilwaco; provided, that this prohibition shall not apply to duly authorized public displays as provided in RCW 70.77.260.

Any person violating or failing to comply with the provisions of this chapter which does not also constitute a violation of state law shall be subject to penalty as provided in Chapter 1.20. Each violation will be punished by a fine of two hundred fifty dollars ($250.00) per violation, not to exceed a fine of two hundred fifty dollars ($250.00) per day that violations occur. If the violator is under the age of eighteen (18), the parents and/or guardian may be held financially liable.
