A. 
Unless otherwise provided by the ordinance establishing a board of supervisors for a service area, the board for the service area shall be composed of three members residing within the service area appointed by the mayor and confirmed by the assembly and having the powers and duties provided in this chapter.
B. 
Members, whether elected or appointed, are authorized to hold other compensated employment with the municipality or the Anchorage School District, provided that the contemporaneous municipal service and employment shall not adversely affect the employee's availability, productivity, or independence of judgment in performing municipal duties.
C. 
An employee of the municipality or the Anchorage School District who also serves as a service area board member is subject to provisions of the code of ethics governing both a municipal employee and governing a member of the service board, whether appointed or elected.

Members of appointed boards established under this chapter shall be appointed by the mayor and confirmed by the assembly. Members of elected boards shall be elected in accordance with the procedures described in title 28. Members of an elected board shall be elected at large within the service area at the regular election of the municipality, except that the first board may be elected at the same time as the first delegation of power is submitted to the voters within the service area.

The term of each member of a supervisory board established under this chapter shall be three years, provided however, the mayor may continue the service of members for up to and including 120 days after expiration of their term to avoid a vacancy until new members are elected or appointed and confirmed. The terms of members initially appointed or elected to boards established under this chapter shall be staggered so that as nearly as possible a pro rata number of members shall be appointed or elected for each year during the regular term of office established for the members of the board.

A board established under this chapter shall meet at the call of the mayor within 15 days of the election or appointment of members in order to organize. The board shall select a chair from the members to preside at meetings. Chapter 1.25 shall govern public notice and minutes of meetings. Except as otherwise provided by law and this section, Robert's Rules of Order, as revised, shall govern all rules of procedure. The board shall meet no less often than quarterly and may meet at other times as called by the chair.

A board established under this chapter shall consult with and advise the assembly and mayor concerning the administration of the affairs of the service area and the services that are being provided. The mayor shall consult with the board in preparing the annual budget for the service area, and the comments and suggestions of the board concerning the budget shall be transmitted to the assembly for its consideration.

A majority of the authorized members of a board established under this chapter shall be a quorum for the transaction of business. In the absence of a quorum for the transaction of business, any number less than a quorum may recess a meeting to a later time or date.

A. 
The office of an elected member of a supervisory board established under this chapter shall become vacant in the same manner as an elected office becomes vacant as provided in section 7.01(a) of the Charter. In addition, a vacancy shall occur on the failure of a member to:
1. 
Attend three consecutive regular or special meetings without excuse; or
2. 
Attend a two-thirds majority of the regular and special meetings during any calendar year without excuse.
B. 
A member intending to be absent at a regular meeting shall request to be excused in advance of the meeting from which he or she will be absent.

If a vacancy occurs in the office of a board established under this chapter, it shall be filled by appointment by the mayor, subject to confirmation by the assembly, upon nomination from the supervisory board. The mayor shall also consider individuals nominated by community councils and associations of property owners in the affected area.

An elected member of a supervisory board established under this chapter may be removed from office for breach of the public trust following the procedures set forth in this section.
A. 
Willful and knowing breach of duty or culpable indifference to official duties may constitute a breach of the public trust. For the purposes of this section actions constituting a breach of the public trust shall include, but are not limited to:
1. 
Acceptance of cash gifts from one doing business with the member's service area;
2. 
Violation of chapter 1.15;
3. 
Perjury;
4. 
Falsification of records;
5. 
Filing false reports;
6. 
Nepotism;
7. 
Making personal use of municipal or school district property;
8. 
Destruction of municipal or school district property;
9. 
Actual or attempted official misconduct, as defined by state law;
10. 
Ordering a municipal employee or contractor employed by the supervisory board to undertake an unlawful act;
11. 
Substantial breach of a statutory-, Code-or Charter-imposed duty.
B. 
Proceedings for removal from office may only be initiated by delivery of an accusation document to the municipal clerk setting forth the grounds for removal and specifying if delivery is to the assembly or the board of ethics. An accusation document may be submitted to the municipal clerk only by a majority vote of the assembly or decision of the municipal board of ethics and must allege specific actions by the member that breach the public trust.
C. 
After a successful vote to submit it, the municipal clerk shall cause a copy of the accusation document to be served on the member in the same manner as service of process under Alaska Rules of Civil Procedure, and a copy delivered to the municipal attorney.
D. 
The municipal attorney shall review the accusation document for legal sufficiency. The municipal attorney shall determine the legal sufficiency of the allegations within ten days of receipt of the accusation document. If the municipal attorney determines that the allegations are legally insufficient, the removal action shall be discontinued. The municipal attorney's determination, if it rejects the accusation document, may be appealed to the superior court within 30 days. No interlocutory appeal is permitted from a determination by the municipal attorney that the accusation document is legally sufficient. Following a determination by the municipal attorney that the accusation document is legally sufficient, it shall be delivered to the municipal administrative hearings office established by Title 14, and the municipality shall employ an attorney of the member's choice, subject to the limitations of this subsection, to defend the charges. The attorney selected must be engaged in the active practice of law in the state. The fees charged by the attorney must be reasonable in both the rate and the amount of time expended. Reasonableness shall be evaluated in accordance with Alaska Bar Rule 35 and shall be subject to fee arbitration under the Alaska Bar Rules if the municipality disputes the reasonableness of the fees claimed.
E. 
A hearing conducted by the municipal administrative hearing officer shall be held no later than 30 days following appointment of the hearing officer. The hearing shall be open to the public and, unless otherwise provided in this section, shall be conducted in accordance with the procedures set forth in chapter 3.60, however the hearing officer shall expedite the matter within the required times set forth in this section and chapter 3.60 and shall grant extensions only for good cause. Good cause must be based upon matters either beyond the control of the party making application or conditions which would create a significant hardship if a continuance is not granted. Within ten days following the conclusion of the public hearing the hearing officer shall submit written findings and recommendations to the assembly. The recommendations shall include whether the member should be removed.
F. 
The standard of proof of the allegations in the accusation document to be applied by the hearing officer is clear and convincing evidence. The hearing officer shall evaluate the evidence relating to the accusations set forth in the accusation document and evaluate both whether the allegations are supported and whether those actions alleged constitute a breach of the public trust as set forth in subsection A of this section. Wrongful acts or admissions occurring while the member was acting in a private capacity as opposed to in a capacity as a public officer shall not constitute a breach of the public trust.
G. 
Within ten days of receiving the hearing officer's recommendations, the assembly shall vote on whether to remove the member who is the subject of the accusation document. Removal shall occur only on the concurrence of two-thirds of the fully constituted body.
H. 
The decision of the assembly acting upon the recommendations of the hearing officer may be appealed to the superior court within 30 days of the assembly's decision. If the assembly's decision is for removal, the office shall be considered vacant beginning at 12:01 a.m. seven days following the decision unless the appellate court issues a stay of the removal pending appeal. In evaluating whether to grant a stay of removal pending appeal, the fact that another individual may be seated as acting member shall not constitute irreparable harm. During a stay, the seat may be temporarily filled pending the outcome of the court case using the procedures in section 27.20.080. If, after exhaustion of appeals, the final ruling reverses the removal, the removed member shall be reseated for the remainder of the term for which the member was elected, and the acting member shall be displaced.
I. 
The assembly shall submit specific written findings for the record showing good cause in the event that the assembly intends to reject the hearing officer's recommendation.

A. 
There is established a board of supervisors for the Chugiak Fire Service Area consisting of three persons elected in accordance with the provisions of this chapter. The board shall be constituted and shall function in the manner prescribed in this chapter.
B. 
The board's duties and responsibilities include the following:
1. 
The board shall oversee the provision of fire services in the Chugiak Fire Service Area.
2. 
The board shall oversee and provide for the maintenance and repair of fire service vehicles and equipment on behalf of the Chugiak Fire Service Area.
3. 
The board shall prepare and submit an annual budget to the municipal administration and the assembly for approval.
4. 
The board shall administer contracts entered into on behalf of the Chugiak Fire Service Area.
5. 
The board shall represent the Chugiak Fire Service Area in the use of Chugiak Fire Service Area resources in the delivery of area wide emergency medical services managed by the Anchorage Fire Department.
6. 
The board shall oversee the participation of the Chugiak Fire Service Area in intra-governmental arrangements for mutual-aid and other cooperation agreements.
C. 
It shall be a priority of the Chugiak Fire Service Area Board of Supervisors to support and maintain Chugiak Volunteer Fire and Rescue Co., Inc. as the primary emergency service provider within the Chugiak Fire Service Area. The administration of the municipality shall not prescribe rules, procedures or guidelines to be followed in furnishing services or expending moneys that interfere with this priority unless mandated by law or emergency.

A. 
There is established a board of supervisors for the Eagle River-Chugiak Park and Recreational Service Area. The board shall consist of a representative and an alternate elected by each community council in the service area and one member at large appointed by the mayor and confirmed by the assembly. The alternate appointee shall serve in place of the principal representative as needed. The board shall advise and assist the department of cultural and recreational services in administering the services to be provided within the area. Subject to the limitations set forth in this title, the board shall have the following specified duties and responsibilities:
1. 
The annual budget, and any subsequent changes, shall be prepared by the municipal administration and reviewed and approved by the Eagle River-Chugiak Parks and Recreation board of supervisors.
2. 
The board shall establish policy guidelines and priorities for the guidance of the municipal administration and department of cultural and recreational services.
3. 
The board shall review and comment to the assembly on all proposed capital projects for the improvement of parks and recreation under the jurisdiction of the service area.
4. 
The board shall review and comment to the assembly on all proposed contracts for services within the service area submitted to the assembly.
5. 
The Eagle River-Chugiak Parks and Recreation manager will keep the Eagle River-Chugiak Parks and Recreation board of supervisors apprised of program changes.
6. 
Before the assembly acts on acquisitions, amendments to the parks and recreation plans, the park and recreation capital improvement program, proposed development of park, recreation or open space facilities, the budget, funding for the capital improvement plan, or ordinances relating to the park and recreation program, and contributions to private recreation organizations and activities, contract or management services, or recommended adjustments to the mill levy, it shall first refer the matter to the board of supervisors for its recommendations and comments.

There is established a board of supervisors for the Girdwood Valley Service Area consisting of five persons elected in accordance with the provisions of this chapter. The board shall be constituted and shall function in the manner prescribed in this chapter in the exercise of fire prevention and protection, street construction and maintenance, solid waste collection, parks and recreation services, the operation and maintenance of a municipal cemetery, the provision of police protection services, and services that support local housing and economic stability, all at the sole expense of the Girdwood Valley Service Area.

There is established a board of supervisors to administer, pursuant to section 27.10.050, the Talus West Limited Road Service Area (TWLRSA), consisting of three members elected for staggered terms of one, two and three years. In the event of a vacancy on the board prior to the expiration of a term, the mayor shall appoint a replacement subject to confirmation by the assembly.

Initial terms of new seats will be matched to the existing staggered election cycle and selected by lot. Vacant seats will be filled by appointment in accordance with the section on filling vacancies in this chapter, and initial appointed terms shall match the election cycle associated with the seat.

There is established a board of supervisors for the Chugiak, Birchwood, Eagle River Rural Road Service Area. The community council with road service supervised by the board shall nominate one of its members for appointment to the board. A councilmember shall also be identified as an alternate appointee to serve in place of the principal member as needed. The nominee and alternate must be approved by the municipal assembly. The board shall advise and assist the department of public works in administering the services to be provided within the area. Subject to the limitations set forth in section 27.10.050B, the board shall have the following specified duties and responsibilities:
1. 
The board shall prepare and submit an annual budget to the municipal administration and the assembly for approval.
2. 
The board shall establish policy guidelines and priorities for the guidance of the public works foreman, who shall have the direct and immediate responsibility for administering contracts for service within the service area.
3. 
The board shall review and comment to the assembly on all proposed capital projects for the improvement of road and drainage facilities under the jurisdiction of the service area.
4. 
The board shall review and comment to the assembly on all proposed contracts for services within the service area submitted to the assembly for approval under the provisions of title 7.
5. 
Upon the unavailability of the public works foreman during any period where road conditions require immediate action, the board shall be authorized to administer and direct the activities of contractors retained to provide service for the service area, provided that the board may not direct any contractor to perform services valued at more than $10,000.00 without the approval of the public works foreman.

There is established a board of supervisors to administer, pursuant to section 27.10.050, the Rabbit Creek View and Rabbit Creek Heights Limited Road Service Area, consisting of three members who shall be elected for staggered terms of one, two and three years. Two members shall constitute a quorum. In the event of a vacancy, the mayor shall appoint a qualified area resident, with confirmation by the assembly, to serve until the next regular election.

All proposed contracts for services within the service area submitted to the assembly for approval under the provisions of Title 7.

The board shall consist of five members elected for staggered terms.

The board shall consist of three members appointed by the mayor and confirmed by the assembly to administer the service area until the regular election of April 2004, at which time the supervisors will be elected for staggered terms. Initial terms of supervisors elected at the regular election of April 2004 shall be elected by lot.
