A. 
Except as provided in this section, no person shall use motor vehicle brakes which are in any way activated or operated by the compression of the engine of any such motor vehicle or any part thereof. It shall be an affirmative defense to prosecution under this section that said compression brakes were applied in an emergency and were necessary for the protection of persons and/or property.
B. 
This section shall not apply to any member of fire protection district No. 4 operating a fire protection district vehicle.

Any person who violates this chapter shall have committed a traffic infraction. The maximum penalty for such a violation shall be $1,000. The bail forfeiture schedule amount shall be set by the King County district court.
