The city planning commission is established.

A. 
It is the intent of the city council to have the planning commission composed of people from all geographical, social, environmental, and economic sectors of the community and to avoid potential conflicts with subsection (C) of this section.
B. 
Each member of the planning commission shall be a Benicia resident and registered voter, and shall be qualified by knowledge and experience to make decisions on questions of community growth and development.
C. 
Members shall not be severely constrained with potential conflicts of interest under the Political Reform Act or the Benicia open government ordinance (BMC Title 4).

In addition to the duties, rights and powers imposed by state law, the commission shall perform the duties and has the rights, powers and privileges provided by ordinance or resolution of the city council.
