Licensing under this chapter is under Division 16.7 (commencing with Section 39000) of the Vehicle Code of the state and any rules and regulations adopted under it.

No resident of the city may operate or use a bicycle propelled wholly or in part by muscular power upon a street, road, highway, or other public property of the city without first obtaining a license from the chief of police.

Every applicant for a bicycle license shall apply to the chief of police. The application shall be on a form provided by the city and shall contain information as may be required by the chief of police concerning the applicant and the bicycle. The chief of police shall not issue a license unless he finds that the bicycle complies with the requirements prescribed for safe mechanical condition.

The annual fee for a license is $2.00, payable to the city with the application. The fee for a transfer of ownership or issuance of a new license after loss or theft is $1.00. The revenue received from license fees shall be used as prescribed by Vehicle Code Section 39004.

The chief of police shall add a penalty of 20 percent of the license fee for failure to pay the fee within 15 days from the date it is due.

The licensing fee and penalty is a debt to the city. The city may bring an action to collect the debt.

A.
Upon approval of the application and payment of the license fee, the chief of police shall issue a bicycle license to be operated in the city for the period of three calendar years beginning the first day of January in the year the license is issued, and ending on the thirty-first day of December of the calendar year three years from the year of issue.

The licensee shall report the loss or theft of a license sticker within 10 days. Upon receipt of the report, the chief of police shall cancel the license and issue a new license sticker to the licensee. Upon the loss of a registration slip, the licensee shall apply for a duplicate slip. The chief of police shall issue a duplicate slip without fee.

Every person in possession of a licensed bicycle who changes his address shall notify the chief of police in writing within 10 days of the change.

Whenever the owner of a bicycle licensed under this chapter sells or otherwise disposes of a bicycle, he shall within 10 days notify the chief of police of such disposition.

A person who purchases or otherwise acquires possession of a bicycle shall within 10 days of taking possession apply for a transfer of licenses to his name.

Every person engaged in the business of selling new or used bicycles in the city shall supply to each purchaser a record of the information required under Section 39006 of the Vehicle Code and shall forward a copy of the record to the chief of police.

Each person engaged in the business of buying used bicycles in the city shall make a monthly report to the chief of police on a form provided by the city, setting forth as to each bicycle purchased:

The name and address of each seller;
B.
The year and make of the bicycle; and
C.
The serial number of the bicycle.

No bicycle retailer shall sell any new bicycle unless the bicycle is stamped or cast as required by Vehicle Code Section 39007.

No person shall wilfully remove, destroy, mutilate, or alter the manufacturer's serial number or the city's serial number on any license plate and registration card during the period the license plate and registration card is operative; or buy, sell, receive, dispose of, or conceal a bicycle or bicycle equipment from which a manufacturer's nameplate, serial number, or other distinguishing mark is removed, defaced, covered, altered, or destroyed.

The chief of police may place a police department serial number on a bicycle if the serial number is obliterated or defaced and the possessor has satisfactory proof of ownership.

Any person riding a bicycle on the sidewalk shall yield the right-of-way to pedestrians and shall give a verbal signal before passing a pedestrian.

Upon a finding by the city traffic engineer that bicycle riding will endanger pedestrian traffic or the public safety on a sidewalk or roadway, the city traffic engineer is authorized to erect signs on the sidewalk or roadway prohibiting the riding of bicycles thereon.

When a person under 18 years of age violates a provision of this chapter, instead of a fine, the chief of police may prohibit the operation upon the streets and public places in the city for a period not to exceed 30 days of a bicycle used in violation. In this case, the chief of police shall impound the bicycle and retain it during the period of prohibition. The owner's registration slip shall be held for a like period.

The remedies prescribed are cumulative, as the use of one does not bar the use of another remedy under this chapter.
