INDUSTRIAL SCALE WECS
A wind energy conversion system capable of generating more than a cumulative maximum power of 5 kW constructed on the property of another by a company or corporation or other entity, whose general intent is to capture wind energy and place it on the electrical grid for resale to a public utility or other energy marketer.
SMALL-SCALE WECS
A wind energy conversion system designed to provide power to a home or other local site for use by the owner whose total height does not exceed 50 feet with a generating capacity not to exceed a cumulative maximum power of 5 kW and shall not entail net-metering capability.
WECS
All necessary devices that together convert wind energy into electricity and deliver that electricity to a utility's transmission lines, including but not limited to the rotor, nacelle, generator, WECS tower, electrical components, WECS foundation, transformer, and electrical cabling from the WECS tower, substation, operational meteorological towers, communications facilities, and other required facilities and equipment, as related to the WECS project.
WECS PROJECT
A collection of multiple WECS as specified in the application for development plan approval and/or improvement location permit.
WECS TOWER
The support structure to which the nacelle, with turbine and rotor, are attached, but may be used in the context of the tower, nacelle, turbine and rotor collectively.
A. 
The remainder of this chapter and all other ordinances notwithstanding, there is hereby imposed a moratorium on the filing, processing, review, and acceptance by the Henderson Fiscal Court; the Henderson City-County Planning Commission (HCCPC); the Henderson County Board of Zoning Adjustment (HCBOZA); the Henderson County Codes Administrator; or any other department, subdivision, agency, board, or commission of Henderson County government of any and all applications for rezoning, conditional use permits, building permits, or other types of applications for both small-scale WECS and industrial scale WECS, and all other WECS projects, WECS towers, and WECS installations.
B. 
This moratorium shall remain in effect until two years after this article amending the Henderson County Zoning Ordinance creating a new article entitled "Article XXXIII, Wind Energy Conversion Systems (WECS)," is adopted by the Fiscal Court or until such time as Fiscal Court amends this article by adopting comprehensive WECS regulations, whichever comes first, unless such moratorium is repealed or extended.
