The board of directors of Hi-Desert Water District hereby finds that all of the recitals of the resolution codified in this section are true and that such recitals are incorporated herein.

It is the policy of the district to assess a capacity fee to a property for the property's water usage based upon the property's actual water usage, measured on an equivalent dwelling unit ("EDU") basis, at the point in time at which the property requests connection to the system (each, an "EDU amount"). Notwithstanding, it is also the policy of the district to increase or decrease such amounts after monitoring a property's actual water usage by recording 12 months of actual EDU water usage at a property beginning 12 months after such property's connection to the system. The district shall determine the actual EDU usage by recording 12 months of actual EDU water usage and, if such EDU usage differs from the EDU usage at the time the property's EDU amount was determined to the point where the property would owe a different capacity fee than originally charged to such property, the district shall adjust such property's capacity fee to reflect the updated EDU usage at the property as set forth herein. Nothing in this section is intended to retroactively change any assessment or final allocation made for any property by way of any assessment district formed to fund the cost of construction of the system.

Upon the district's evaluation beginning 12 months after a property's connection to the system, the district will determine whether the property's water usage on a per-EDU basis is less than the initial projected water usage for the property per the EDU amount. If recording 12 months of actual EDU water usage indicates the water usage on a per-EDU basis has decreased below the property's projected water usage per the EDU amount for the property, then the property's capacity fee will be decreased commensurately. At all times, it is the policy of the district that the capacity fee for a property will reflect a minimum level of water usage of one EDU, regardless of any lesser amount of flows actually used by the property. The district will apply the appropriate capacity fee reduction for the months that have elapsed since the district's evaluation revealing the property's decreased water usage as a credit to the property's wastewater/sewer service account. Nothing in this section is intended to retroactively change any assessment or final allocation made for any property by way of any assessment district formed to fund the cost of construction of the system.
