The use of engine brakes, exhaust brakes, jake brakes or other device which performs the same function as this equipment is hereby prohibited within the city limits of the city of Richland, Washington. Unmuffled exhausts, as described and set forth in RCW 46.37.390, are prohibited. It shall be an affirmative defense to prosecution under this section that compression brakes were applied in an emergency and were necessary for the protection of persons and/or property. Further, this section shall not apply to any emergency vehicle when responding to an emergency.

The city shall install, or cause the installation of, signs prohibiting the use of engine brakes and unmuffled exhausts within the city at the entrances to the city where use of such equipment has been noted. The traffic engineer shall cause the placement of additional signs within the city at such locations as will provide notice that such use of engine brakes is prohibited.

Any person violating the provisions of this chapter shall have committed a traffic infraction. Each infraction shall carry a penalty of $100.00 in addition to any court cost assessed by the Benton County district court.
